RESOLUT'ION NO. 08-
A RESOLUTION OF THE TIGARD CITY- COUNCIL DECLARING THE NEED TO
ACQUIRE PROPERTY FOR. THE PURPOSE OF CONSTRUCTING A PORTION OF
LOWER FANNO CREED.PARK IN THE CITY OF TIG
WHEREAS, the Tigard City Charter grants the City authority to acquire land for public purposes;
and
WHEREAS, as part of the Downtown Urban Renewal Plan, the City of Tigard has identified the
Lower Fanno Creek Park as a key project in the Fanno Creek Pare Master Plan;and
WHEREAS,,in order to the construct the park,the City needs to acquire properties,including a
portion of the Stevenson property; and
WHEREAS, in order to construct street improvements along Burnham Street and.Ash Ave..,the
City needs to acquire right-of-way from Stevenson;and
WHEREAS, the property owner has requested the City consider condemnation for the back portion
of his property and street right-of-way;and
WHEREAS, a Resolution of Necessity is needed to proceed with acquisition of the property for
construction of a portion of Lower Fanno Creek Park and right-of-way for street improvements.
NOW,THEREFORE BE IT RESOLVED by the Tigard City Council that:
SECTION 1. The Tigard City Council does hereby find and declare that the property located in
the City of Tigard, Washington County, Oregon is needed and requited for the
construction of a portion of Lower Fanno Creek Park. Exhibit A (aerial view of the
property) and Exhibit B (site description) are attached hereto and incorporated
herein by this reference.
SECTION 2: The Tigard City Council does hereby find and declare that the right-of--gray property
located along the Stevenson frontages of Burnham Street and Ash Ave. in the City of
Tigard, Washington County, Oregon is needed and required for the construction of
street improvements.
