RESOLUTION NO. 07- ;
A R7SOLUTION APPROVING THE PURCHASE OF THE SCI-LUTZ PROPERTY LOCATED AT
13335 SW I LU L BLITD, TIGARD, OREGON, (-FAX LOT 2S102DA00800) ADJACENT TO OTHER
CITY PROPERTY
WHEREAS, the City Council has expressed interest in purchasing the "Schaltz Property," (the "Property"); and
WIIEREAS, on or about November 7, 2007 before putting the Property on the open market, Randy and
N,Jargaret Schaltz (die "Property Owners") expressed interest in selling the Property to the City if a timely-
agreement could be approved before December 12,2007;and
WHEREAS, under the Property Acquisition Workbook this type of property may be acquired di ough fast
trach options with consultation with the City Attorney;and
WHEREAS, in accordance Widi the direction of the City Council and consistent with the property acquisition
Procedures, an offer to buy the Property was submitted to die Property Owners;and
WHERE-AS, pursuant to dhe conditions set forth above, the Property Owners made a counter offer
substantially the same as the City's offer, accepting the purchase price and contingencies; and
WHEREAS, dais counter offer was deemed acceptable to die Citi arid
WHERL.AS, the appraisal and environmental assessments have been completed and approved by die City's
Public Works Director;and
WI IEREAS, all of die contingencies of the purchase offer required of the City have been met except for die
City Council's approval of die sale.
NOW,THEREFORE, BE IT RESOLVED by die Tigard City Council drat:
SECTION 1: The City Council hereby approves die purchase of the Property bill die City.
SECTION 2: The City Manager shall take the necessary steps to close the purchase as set forth in the
agreement widi the Property Owners.
SECTION 3: This resolution is effective i imediately upon passage.
