RESOLUTION NO. OS-
A RESOLUTION DISCONTINUING THE LOCAL IMPROVEMENT DISTRICT (LID)
FORMATION PROCESS FOR THE PROPOSED 79TH AVENUE LID.
WHEREAS, a Preliminary Engineer's Report for a proposed Local Improvement District(LID) is intended
to examine the proposed LID in detail and provide the basis for determining the feasibility of forming a
district for construction of infrastructure improvements; and
WHEREAS, City Council through Resolution No. 5-24 approved the preparation of the Preliminary
Engineer's Report for the proposed 79"'Avenue Local Improvement District(LID); and
WHEREAS, a preliminary progress report midway through the preparation of the Preliminary Engineer's
Report produced estimated costs that were higher than expected; and
WHEREAS, the properties within the proposed LID boundary are relatively large and the amounts to be
assessed to those property owners not planning development would be a huge burden to those owners; and
WHEREAS, anticipated improvements by developers on 79`x' Avenue proportional with the size of their
developments are expected to resolve most of the major vertical alignment issues within the proposed LID
boundary; and
WHEREAS, City Council discussed options regarding the anticipated improvements at its meeting on
September 20, 2005 and concluded that the LID effort should be discontinued at this point.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION I: The Engineering staff is directed to discontinue the LID formation process by
terminating work on the on the preparation of the Preliminary Engineer's Report.
SECTION 2: This resolution is effective irmnediately upon passage.
