RESOLUTION NO. 05-q
A RESOLUTION ADJUSTING SOLID WASTE RATES DUE TO CHANGES JN THE SOLID WASTE
INDUSTRY, IMPLEMENTING NEW RECYCLING PROGRAMS, AND ADJUSTING THE
FRANCHISE FEE TO 4% OF ANNUAL GROSS REVENUES.
WHEREAS, TMC Section 11.04.090.E provides that adjustments to solid waste rates be discussed at a
public hearing and adopted by Council resolution; and
WHEREAS, it is the desire of the City Council to eventually have solid waste rates be profitable by each
service type(i.e., cart, container, crop box)based on cost of service; and
WHEREAS, the City Council has reviewed the current recycling program and desires to implement a
container based residential recycling program to increase recycling and divert recyclables from the landfill,
and
WHEREAS, the current franchise fee is 3% of gross revenues, and the City expects additional costs to
implement Metro directed programs, and
WHEREAS,the last rate adjustment was made in October 2001.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The Tigard City Council hereby approves an adjustment in the current solid waste rates,
attached is Exhibit "A", to provide a 10% aggregate rate of return on gross revenues,
effective August 1,2005.
SECTION 2: The Tigard City Council hereby approves an adjustment in the current solid waste rates,
attached is Exhibit"B", effective January 1,2006.
SECTION 3: The Tigard City Council hereby approves adjustment to solid waste rates to implement a
container based recycling program, as well as establishing a franchise fee of 4%,
effective January 1,2006.
