RESOLUTION NO.04-30
A RESOLUTION INITIATING VACATION PROCEEDINGS TO VACATE AN APPROXIMATELY
4,387 SQUARE FOOT PORTION OF PUBLIC RIGHT-OF-WAY BETTER KNOWN AS SW 72ND
AVENUE WHICH LIES AT THE SOUTHWEST CORNER OF THE BORDERS/BED BATH AND
BEYOND COMMERCIAL CENTER(VAC2004-00001).
WHEREAS,the approximately 4,387 square foot portion of right-of-way had previously been dedicated to
the public;and
WHEREAS,the applicant has requested that the City of Tigard initiate Vacation proceedings to vacate an
approximately 4,387 square foot portion of public right-of-way, as described in Exhibits "A-1, A-2 and
A-3"and shown in Exhibits"B-1,13-2 and B-3"better known as SW 72nd Avenue;and
WHEREAS, the approximately 4,387 square foot portion of land had previsouly been dedicated to the
public;and
WHEREAS,the said portion of public right-of-way may no longer be necessary due to the realignment of
SW 72nd Avenue;and
WHEREAS,the Tigard City Council finds it appropriate to initiate Vacation proceedings for the requested
public right-of-way vacation.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The Tigard City Council hereby initiates a request for the vacation of an approximately
4,387 square foot portion of public right-of-way commonly know as SW 72nd Avenue,
as more particularly described and shown in Exhibits "A-1,A-2,A-3" and "B-1,B-2
and B-3"and by reference,made a part hereof.
SECTION 2: A public hearing is hereby called to be held by the City Council on July I3,2004 at 7:30
PM in the Town Hall at Tigard City Hall, 13125 SW Hall Boulevard,within the City of
Tigard, at which time and place the Council will hear any objections thereto and any
interested person may appear and be heard for or against the proposed vacation of said
public right-of-way.
