RESOLUTION NO.03-01
A RESOLUTION WAIVING PURCHASING RULE 70.020"SCREENING AND SELECTION POLICY
FOR PERSONAL SERVICE CONTRACTS" FOR ENGINEERING SERVICES ON THE GAARDE
STREET RETAINING WALLS PROJECT
WHEREAS,in order to correct the work of a previous contractor,the City entered into an agreement for
engineering services with DeHaas&Associates for work on the Gaarde Street Retaining Wall Project;
WHEREAS,the nature and scope of the work being performed was increased due to limited right-of-way,
change in existing grades,and other factors;
WHEREAS,staff should have formulated and advertised a Request for Proposal for the additional scope in
the work, and furthermore, should have, once the project exceeded $25,000,brought the project to the
attention of the Local Contract Review Board;
WHEREAS,soliciting a new consultant would have drawn valuable time from the project,and
WHEREAS,DeHaas&Associates was deeply involved with the project and focused in its work with the
City;
WHEREAS, staff, determined it to be beneficial to the City to continue the relationship with DeHaas&
Associates for the completion of the project and increase scope of work of the original contract to include
these additional services,
NOW,THEREFORE,BE IT RESOLVED by the Local Contract Review Board that:
SECTION 1: The Local Contract Review Board waives Purchasing Rule 70.020 "Screening and
Selection Policy for Personal Service Contracts"for the work being performed on this
project by DeHaas&Associates.
SECTION This resolution is effective immediately upon passage.
