A RESOLUTION ACCEPTING THE MUTUAL RELEASE AS AGREED TO BY NORTHLAND
INSURANCE COMPANY AND THE CITY OF TIGARD
WHEREAS,the City of Tigard filed a claim against Northland Insurance for coverage and reimbursement
under Northland Insurance Company policies in effect during the matter of Dolan v.City of Tigard,512 US
374 (1994) and subsequent additional legal action presented against the City of Tigard in Washington
County Circuit Court(Case No.C941259CV);and
WHEREAS,the City of Tigard, decided that it was in the best interests of the community to attempt to
negotiate a settlement with Northland insurance Company;and
WHEREAS,the Tigard City Council provided an opportunity for both the City of Tigard and Northland
Insurance Company to present and evaluate each other's perspective regarding the issues in dispute;and
WHEREAS, the City of Tigard and Northland Insurance Company agreed upon a mutual release to be
executed by representatives of the City of Tigard and Northland Insurance Company that will settle all
claims upon payment of$450,000.00 by Northland Insurance Company to the City of Tigard;and
WHEREAS,the Tigard City Council determined that the mutual release represents a fair settlement for the
City of Tigard.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The Tigard City Council hereby authorizes the Mayor to execute the mutual release and
settlement and all necessary documents to resolve this matter on behalf of the City of
Tigard.
