Resolution No. 99-14 CITY OF TIGA RD,OREGON RESOLUTION NO.99-14-4 A RESOLUTION OF THE T IGARD CIT' COUNCIL v ii•vS'iP:G LEGISLATION (SR 512) CREATING A NEW STATE BOARD TO REGULATE BUILDING CODE ACTIVITIES IN THE PORTLAND METROPOLITAN AREA,AND SUPPORTING THE ESTABLISHMENT OF AN INTERGOVERNMENTAL AGREEMENT TO LNRANICr. CONSISTENCY AND SERVICES IN BUTILDING CODE ENFORCEMENT. WHEREAS,the Metropolitan Building Codes Consolidation Task Force has addressed,in its report to the Legislature,several issues of building codes service which should be improved and enhanced in the metropolitan area;and WHEREAS,the City of Tigard supports the service improvement concepts identified by the Task Force; and WHEREAS,the Task Force has recommended and it has been proposed that the 1999 Legislature enact a law(SB 512)creating a new State Board to coordinate building code activities in the Portland metropolitan area toward implementing the identified service improvements;and WHEREAS,based upon the described duties and authority of such a State Board,the City believes that the detrimental effects of the proposed legislation will outweigh its benefits and is therefore not the appropriate mechanism to implement the identified service improvements;and WHEREAS,the Tigard City Council desires to go on record as opposing such legislation which includes provisions which are detrimental to the interests of the City and the public it serves;and WHEREAS,the Tigard City Council supports the concept of an intergovernmental agreement among jurisdictions in Clackamas,Multnomah and Washington Counties as the appropriate mechanism to enhance consistency and services in building code enforcement; and WHEREAS,alternative legislation is proposed which provides for such an intergovernmental agreement among jurisdictions in Clackamas,Multnomah and Washington Counties;and WHEREAS,the Tigard City Council believes it is important that jurisdictions in Clackamas,Multnomah and Washington Counties be required to participate in such an intergovernmental agreement;and H WHEREAS,the alternative legislation proposes that local participation in the intergovernmental agreement be a condition of building code program delegation from the State; 5 BE IT RESOLVED by the Tigard City Council that: Section 1. The City Council opposes any legislation creating a new State Board to regulate buiiding code activities within the Portland metropolitan area,to the extent that such iegisiatio n: RESOLUTION NO. 99_ _ i:\citywide\m\39sb512.dw Page I ' a. Creates another layer of government relating to bolding code regulation; b. Deuruascs,uc_;cuntr^]ofhtlitding code administration and erodes the ability of local jurisdictions to provide development services; C. Increases building permit costs to subsidize the operations of another State Board; I d. Affects the authority of iocal jurisdictions to set fees to meet local nezds; e. Creates a second entity with authority to license inspectors and plan examiners;or f. Creates a second code interpretation board within the state. Section 2 The Tigard City Council supports the concept of a required intergovernmental agreement among jurisdictions in Clackamas,Mi_�ltnomah and Washington Counties,having the 0b;ect;Ve of: a. Developing common building permit application forms and information packets on plan submittal requirements,together with a common"job card"for on-site inspections; b. Developing standardized manor label forms,a standard database for tracking labels and procedures for directing labels to the appropriate jurisdiction; C. Establishing a tri-county plan review training program; d. Creating a timely,responsive disputa resolution process; e. Pursuing other means of enhancing consistency and services in building code regulation.
