Resolution No. 98-58 CITY OF TIGARD,OREGON RESOLUTION NO.98-_� A RESOLUTION OF THE TIGARD CITY COUNCIL,ADJUSTING FEES AND CHARGES TO REFLECT CHANGES IN LAND USE APPLICATION PROCESSING COSTS, REPEALING RESOLUTION NO. 96-30, AMENDING RESOLUTION NO. 97-20 AND SETTING AN EFFECTIVE DATE OF NOVEMBER 26,1998. WHEREAS,the City of Tigard has adopted planning ordinances pursuant to Chapters 227 and 92 of the Oregon Revised Statutes; and WHEREAS,the adopted planning ordinances require that for the purpose of defraying the expenses arising from or incident to the investigation,evaluation and processing of land use applications,fees and charges be prescribed; and WHEREAS,Section 3.32 of the Tigard Municipal Code grants the City Council the authority to set rates for fees and charges by resolution; and WHEREAS,the Tigard City Council reviewed a cost analysis of land use related applications on Febr-mry 20,1996 and April 23,1996; and WHEREAS,the Tigard City Council desires to set rates at 100 percent cost recovery of processing land use applications to reduce the burden on the general fimd; and WHEREAS,the Tigard Cit} Council adopted a new development code on July 28, 1998 with different s application types to be effective November 26,1998; and WHEREAS,the effective date for revised fees and charges is to be November 26, 1998. NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that: SECTION 1: Resolution No. 96-30 and all amendments thereto is hereby repealed in its entirety and fees and charges shall be established according to the attached new fee schedules, Exhibit "A" (City otf Ti and fees) and Resolution No. 97-20 is hereby amended according io Exhibit`B"(Washington County urban service area fees). SECTION 2: This resolution shall be effective on and after the fust day of November 26,1998. SECTION 3: The City Council determines that the fees and charges impposed by this resolution are not taxes subject to the property tax limitations of Article X1, Section 1 )of the Oregon Constitution.
