Resolution No. 97-53 t r CITY OF TIGARD,OREGON t RESOLUTION NO.97--'�3 g A RESOLUTION ADOPTING A SUPPLEMENTAL BUDGET FOR THE 1997198 FISCAL YEAR. # Y WHEREAS, The settlement in the Dolan case has created an obligation for the City in the amount of S 1,500,000 the expenditure of which was not included in the 1997198 adopted budget,and, �sy WHEREAS,local budget lav allows the adjustment of the adopted budget through a supplemental budget for conditions which were not known at the time of budget preparation which require a change in financial planning,and, ;. �. i fi ", WHEREAS, the proper notices were placed in the Tigard Times advertising the supplemental budget hearing + which was properly held on December 9, 1997. "x ` t NOW, THEREFORE,BE 1T RESOLVED by the Tigard City Council that the supplemental budget is approved as proposed. The meeting will be held on Tuesday,December 9, 1997 at Tigard City Hall,13125 SW Hall Blvd.in the Town Hall room and will begin at 7:30 p.m. ry` EEif A copy of the proposed supplemental budget may be inspected at Tigard City Hall from 8a.m.to s., 5p.m.Monday through Friday beginning on Monday.November 24,1997. r � General Fund } i Resource Requirement Beginning Fund Balance $1,500,000 General Capital Improvements $1,500,000 {� First Notice publish in the Tigard Times November 20,1997. Second Notice published in the Tigard Times,November 27,1997. E' This supplemental budget is intended to provide the City the budget authority to pay it's .: obligation in the Dolan settlement. The 1997/98 adopted budget did not include an appropriation specifically for this settlement. The estimate for beginning balance in the general fund anticipated the expenditure for a settlement in the previous year. Because the trial was delayed into 1997/98,'. y , the anticipated expenditure was.not made, thereby making:the actual beginning:balance in $ 1997/98 larger than anticipated in the budget. NV17% ' The supplemental budget recognizes the larger than anticipated beginning fund balance as an additional resource and appropriates it in the general fund,.capital improvements program. If, approved by the Council at the hearing on December 9,1997,the supplemental budget gives the Citythe authority to make payment on the settlement on December 10,1997 in accordance with the settlement agreement. z 7 Because the supplemental budget changes the budget by more than 10%in the general fund,two notices were required. The date each notice was published is shown above.Local budget law- ki Fallows that within 10 days of the first notice,ten interested taxpayers may request in writing that> s„, t5 t s ithe hearing be held by the budget committee.
