A RESOLUTION AMENDING RESOLUTION NO.96-69. i

WIlEREAS, the City of Tigard,by Resolution No_96-69 and pursuant to the terms of ORS 271.330(1),
declared a certain parcel of real properly that was used mid maintained by the City as part of its City street
system as surplus to be returned to the State of Oregon Department of Transportation for disposition;and 3
WHEREAS,the State of Oregon does not wish to accept all of the real property described by Resolution
s No,96-69 and recommends the City declare a smaller area as surplus.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: That Resolution No.96-69 is hereby amended and the real property on Exhibit"A"
.attached hereto and as shown on the Map attached hereto as Exhibit"B"is hereby
declared as surplus and to be returned to the State of Oregon.
t v SECTION 2: Further,the Tigard City Council hereby authorizes the City Manager,or his designee,to
sign a statutory quit claim deed conveying the real property from the City to the State of
�a Oregon.

WHEREAS, the City of Tigard,by Resolution No.81-I2 and pursuant to the terms of ORS '
271.330,accepted from the State of Oregon a certain parcel of real property located within the city fir,
' limits of the City of Tigard to be used and maintained by the City as part of its City street system;and a '
WHEREAS,the City of Tigard no longer believes that said property is necessary For use by it as a
yCity street and now wishes to convey said property back to the State of Oregon Department ofx
Transportation for disposition;and
WHEREAS,pursuant to the terms of ORS 271.330(1),the City has the authority to relinquish title ,
