ARESOLUTION CONCERNING THE VACATION OF APPROXIMATELY 4,431 SQUARE FEET OF
PUBLIC RIGHT-OF-WAY ON SW TORLAND COURT. "WIl

WHEREAS,the right-of-way for SW Torland Court had beendedicated to the public(Book 90,Pages 50,51);
and,
WHEREAS,Southwest Torland Court stubs at the property line of tax lot 6200;and, r
WHEREAS,the progeny owners of tax lot 6200,created with the recording of a foal partition plat(MLP 94-
`( 0005)on May 10,1994,desire to partition tax lot 6200 to create an additional two lots.

a WHEREAS,City codes require the extension and/or provision of a turnaround for SW Torland Court;and, _ )

WHEREAS,such an improvement would render the proposed partition not feasible;and, 'r'; y
WHEREAS,the applicant contends that extension of SW Torland Street is not necessary given the surrounding t iiffi
i
development patterns;and,
(
WHEREAS,the approximately 4,431 square feet of public right-of-way is no longer necessary;and. y
HEREAS,the Tigard City Council finds it appropriate to initiate proceedings for the requested vacation.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that: �'';`` "r 'w

Section 1: The Tigard City Council initiates a request for the vacation of approximately 4,431 square s
feet of public right-of-way on SW'foriand Court.as more particularly described in Exhibits 1

Seet2an 2: A public hearing is hereby called to be held by the City Council on Tuesday,October 22
-Iall, 13125 SW Hall Boulevard,.within the.City of
1996.at 7:30 p.m.at Tigard City I
.Tigard, at which time and place the Council will hear any objections thereto, and any .
interested person may appear and be herd for or against the proposed vacating of said

Section 3: The City Recorder is hereby authorized and directed to cause to have published in the mA
Tigard Times;a newspaper of general circulation in the City of Tigarda notice of said
hearing;the first publication to be on October 3, 1996 and the final pu-H anon to be on
