EFFECTIVE DATE.
WHEREAS, the City of Tigard has adopted planning ordinances pursuant to Chapters 227 and 92 of the rr,
t Oregon Revised Statutes;and t

WHEREAS, the adopted planning ordinances require that for the purpose of defraying the expenses
i -arising from or incident to the investigation,evaluation and processing of land use applications,fees and
charges be prescribed;and
WHEREAS, Section 332 of the Tigard Municipal Code grants the City Council the authority to set rates
for fees and charges by resolution;and

WHEREAS,the Tigard City Council reviewed a cost analysis of land use related applications on February sr
20,1996 and April 23,1996;and x

WHEREAS, the Tigard City Council desires to set rates at 100 percent cost recovery of processing land s
use applications to reduce the burden on the general fund;and y,a

WHEREAS,the effective date for revised fees and charges is w be July 1,1996. } ,5
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:

SECTION 1: Resolution No.91-01 and all amendments thereto is hereby repealed in its entirety and
fees and charges shall be established according to the attached new schedule,"Exhibit

SECTION 3: The City Council determines that the fees and charges imposed by this resolution are
not taxes subject to the property tax limitations of Article X1,Section I I(b)of the
Oregon Constitution..
