r WHEREAS,the Tigard City Council desires to manage solid waste rates in a manner which is consistent with the
Solid Waste Management Ordinance(TMC 11.04);and
WHEREAS,the Tigard City Council wishes to establish policies for solid waste management to insure rates arejust,
,j fair,reasonable and adequate to provide necessary service to the public;and
WHEREAS,the Tigard City Council held a public hearing on January 23,1996 to receive public testimony consider

(1)changing garbage collection service to only be available 3"rears and to diseoodnue the use of em's in Tigard;and
Y {2}modifying the residential yard service rate froma charge of$.01 per four per can per month to a flat rate of$3.00
� per month per cart that isnot placed within i3 feet f the curb for collection;and

WHEREAS,this change would encourage,through the rate structure,the placement of carts at curbside for a more
efficient me of-.e automated collection system and contint e o keep solid waste rates at a reasonable and adequate r
level to provide the services;and 1
WHEREAS,Resolution No.95-23 needs to be amended to reflect the rate change for yard service rates and remove
the reference to"can"in the Miscellaneous Service Rates Section referenced in Exhibit"A"of that resolution.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The Tigard City Council hereby orders that,effective 3/1/96,cans will no longer be serviced for a
garbage collection in the City of Tigard.The Tigard Solid Waste Haulers will provide carts or containers that can s
be serviced with automated collection equipment.
SECTION 2: The Tigard City Council,effective 3/1!96 hereby amends Exhibit"A"of Resolution No.95-23 by
changing the rate for yard service and removing references to"can"in the Miscellaneous Service Rates section as
follows:
