As you may be aware United States National Bar><'-.of Oregon is administering a trust established
by W istine A.T_p __6 who died January 4,1995. upon 2virs.Tupling's death,the trust was to
continue for the benefit of Mr.Tupling and ultimately be distributed to named residual
beneficiaries. The Trust Agreement contains a contingent provision as follows: .'
1:
"If trustor's spouse is not living,$100,000 shall be distributed to the CITY OF
TIGARD,OREGON,to be used by the City for the purchase and development of
parks::If trustor's spouse is living,this gift shall lapse and this trust shall be s
construed as if the CITY OF TIGARD was not designated a beneficiary of this
trust_ `,fita�.c
Normally,this gift would not be payable since Mr.Tupling survived his wife. By virtue of the
s fact that Mr.Tupling recently decided to disclaim all of his interest in the trust,this provision
¢ does not lapse.:Inother words,the terms of the trust agreement are interpreted as through Ivies `'
