A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO SIGN ON BEHALF OF THE
CITY A QUITCLAIM DEED EXTINGUISHING AN EXISTING, UNUSED, EASEMENT WITHIN
THE MAIN -STREET APARTMENT SITE.
WHEREAS, development. of Mair: Street Apartment site. SDR 92-0022,
necessitated the relocation of a portion of a public sanitary sewer; and
WHEREAS, said sanitary sewer within the easement described by the
attached Exhibit "A" has been abandoned leaving no need for the
easement; and
WHEREAS, a replacement sanitary sewer has been constructed within a new
alignment through the site and a new easement Yeas been crcared therefor
eliminating the need for th-e sanitary sewer easement described by the
attached Exhibit "A"; and
WHEREAS, the Tigard City Council finds that the new alignment- is
adequate for the sanitary sewers now in use and does serve the needs of
the drainage basin..
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1. The City of Tigard hereby extinguishes its interest in the
easement area described by the attached Exhibit "A" .
Section 2. Furthe the Tigard City Council hereby authorizes the City
AcLministrator to sign a Statutory Quitclaim Deed
extiT,i7uishing the City's interests in the easement so
described.
