CITY OF TIGARD
A RESOLUTION OF THE CITY OF TIGARD, OREGON, MAKING EMPLOYEE
RETIREMENT CONTRIBUTIONS NOT SUBJECT TO STATE AND FEDERAL
WITHHOLDING.
WHEREAS, the State of Oregon Constitution, Article IX,' as
amended, will require public employees to contribute an amount
erual to six percent (6$) of their salary os gross wage to the
retirement plan provided by their employer Effective January 1,
1995; and
WHEREAS, the City !!as sntsrad --tv - yiv acts th its
employees whereby the City will pay contributionsto PERS or other
retirement plans through June 30, 1996; and
WHEREAS, employees hired into PERS coverc ^vn-represented and
management positions after January 1, 1995, will be covered by
a contract. Therefore, employees will be required to contribute
the amployee contribution of six percent (6%) to P3RS or other
retirement plans from funds deducted from employee salaries; and
WHEIEAS, all employees will be require-ad to contribute the
employee contribution of six percent (62%) to PERS or other
retirement plans from funds deducted from employee salaries
effective June 30, 1996; and
WHEREAS, the City wishes to permit employees, raying the
employee portion of the PERS or other retirement pian contribution,
to do so in pre-tax dollars;
NOW, THEREFORE, BE IT RESOLVED BY THE C=Y COUNCIL OF THE CITY
OF TIGARD THAT:
SECTION 1: The employee contribution of six percent (6%) of
salary to PERS or other retirement plan is deemed
to be "picked iip° by the City for purposes of
Section 414(h)(2 ) of the Internal Revenue Code.
SECTION 2: Payment of the six percent (6%) contribution
through payroll deduction is mandatory for each
employee who is a member of PERS or other
retirement plan. Employees do not have the option
of receiving the salary payment in cash and paying
the PERS or other retiremer_t plan contribution
directly.
SECTION 3: The dross wages of employees on the W-2 form for
federal and state income tax purposes will be
reported by the City for tax purposes will be
reducsd by the amount of the employees'
contributions. '
