RESOLUTION NO. 94- CR
A RESOLUTION OF THE TIG_ARD CITY COUNCIL AUTHORIZING THE CITY
ADMINISTRATOR TO SIGN ON BEHALF OF THE CITY AN AFFIDAVIT CANCELING THE
CITv_i c INTEREST IN A WATER RIGHT.
WHEREAS, a water right was conveyed to the City as a result of a right-
of-way dedication for the Marion Estates Subdivision (SUB 92-07); and
WHEREAS, the water rights are unused; and
WHEREAS: the water Master has requczted that the City cancel its
interest; and
WHEREAS, the City Council finds that it is in the best Interest of the
public to cancel the water right.
NOW; THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1. The City of Tigard hereby cancels its interest in a
portion of a right described by the certificate recorded
at page 32496, State Record of Water Right Certificates
in the name of Mrs. Myron P. Dressler.
Section 2. Further, the Tigard City Council hereby authorizes the
City Administrator to sign a affidavit canceling the
water right.

I, Patrick J. Reilly, Tigard City Aci ninistrator, being first duly
sworn, depose and sav that the City of Tigard is the owner of land

further described as^Marion Drive just south of Washington County
tax lots 2S111CB-02800 through 03100, to which a water right is
appurtenant, for the use of not to exceed .0022 cubic feet per
second of water from a well, tributary of the Tualatin River, for
the irrigation of .21 acres in the NWk of the SW'; of Section 11,
ON Township 2S, Range 1W, WM, with a priority date of Tuly 12, 1960,
being a portion of the right described by the certificate recorded
at page 32496, State Record of Water Right Certificates in the name
of Mrs. Myron P. Dressler, and that the city has abandoned any and
all interest in and to sail wa-er right and hereby authorizes
cancellation.
