Resolution No. 93-63 WE min Rim Em NEW CITY OF TIGARD, OREGON RESOLUTION NO. 93- X03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIGARD CALLING FOR A SPECIAL ELECTION TO BE HELD ON 11AY 17, 1994. WHEREAS, a public hearing was held on December 14, 1993, to receive input from the citizens of Tigard on a proposed charter amendment; and WHEREAS, after due consideration, the Tigard City Council has decided to forward the proposed charter amendment to the voters; NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: Section 1. An election is hereby called in and for the City of Tigard. Washington Count-y. Oregon i or the =•:^Y ce of .. submitting to the legal voters of said City the following question: Shall the City of Tigard amend �^ ^.ate ter relating to the filling of vacancies on the City Council? Section 2. Tuesday, May 17, 1994, between the hours of 7:00 a.m. and 8:00 p.m., is hereby designated the date and time for holding the election for the purpose of voting on the r measure as stated in the above paragraph. Section 3. The election will be conducted by the Washington County Elections Department, which department shall establish polling places, precincts, and election boards for such election. Section 4. The precincts for said election shall be and constitute all of the territory included within the corporate limits of the City of Tigard. Section 5. The ballot title to appear on the ballots shall be: CAPTION: CITY OF TIGARD CHARTER AMENDMENT QUESTION: Shall the City of Tigard amend its Charter relating to the filling of vacancies on the City Council? SUMMARY: Section 7 of the Tigard Charter provides that vacancies on the City Council are filled by holding a special election. if this measure is passed, the Council may either appoint a person or call a special election to fill she vacancy. The Council may only call for an election if the election can be held at least one year before the term otherwise expires. This measure also allows a person appointed to fill a vacancy to run for f that position in a vacancy filling election. t RESOLUTION NO. 93- rage 1 Section 6. The City Recorder of the City of Tigard is hereby directed to publish the proposed charter amendment in full, together with the ballot title, in one issue of the Tigard Times, being a newspaper of general circulation in the City of Tigard, Oregon, within twenty days to the election. Section 7. The City Recorder of the City of Tigard is hereby directed to post notices of said election in one place in each voting precinct of the City. These notices shall be posted at least ten (10) days before the date set ±'or the election. The City Recorder shall give additional notice of the aforesaid City election by publication in the Tigard Times, being a newspaper of general circulation in the City of Tigard, Oregon, once each week for two guns-cutive week4s_ thw first publication to be net less than ten (10) days before the election. MAYOR AND COUNCIL. The elective officers of the city shall be a mayor and four councilors who together shall j constitute the City Council. At the ge.-ieral election held In 1990, and every fourth year thereafter, a mayor shall be elected for a term of four years. No councilor shall serve the city as councilor for more than eight consecutive years, nor shall the mayor serve as mayor for more than eight consecutive years. In no case shall any person serve on the City Council for more than twelve consecutive years. These limitations do not apply to the filling of an unexpired term. No person who is serving as mayor or councilor shall become a candidate for any city office for a term which would be concurrent with the term in office thein held unless that person first submits a written resignation from the then current office at the time of i+ filing for the other office. A resignation submitted to satisfy this section shall not be withdrawn. A resignation shall be adequate for the purposes of this section if it provides for the termination of the signer's service in the office not later than the last clay before service would begin in the office for which +F that person seeks to become a candidate. in the event the office of mayor or councilor becomes vacant before the normal expiration of its term, a special election may be held at the next available date to fill the office for the unexpired tern. Such an election shall only take place if the Council can schedule and hold a special election at least twelve months before the term would otherwise expire. If an election is held, it shall be held in accordance with the election laws of the State of Oregon and city ordinances not inconsistent with such election laws.
