RESOLUTION NO. 93-:3 j
A RESOLUTION INITIATING LEGALIZATION PROCEEDINGS FOR PORTIONS THE RIGHT-OF-WAY
OF S.W. 93RD AVENUE AND S.W. 112TH AVENUE IN THE CITY OF TIGARD AND SETTING A
PUBLIC HEARING.

WHEREAS, the City of Tigard had previously given approval for development on
certain portions of land; and
WHEREAS, as a condition of those developments it was required that public
right-of-way be established; and
WHEREAS, portions of the right-of-way for both S.W. 93rd Avenue and S.W. 112th
Avenue have never been created; and
WHEREAS, ORS 223.935 allows City governing bodies a procedures to legalize
roads within the City boundaries; and
WHEREAS, the Council finds it necessary to initiate proceedings to legalize
portions of the right-of-way of S.W. 93rd Avenue and S.W. 112th Avenue and
remove all doubt concerning its location;
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section l: The City Council hereby initiates legalization proceedings for
portions of the right-of-way for S.W. 93rd Avenue and S.W. 112th Avenue, and s
directs that:
1. The City Engineer have the right-of-way surveyed by a Professional
Land Surveyor registered in the State of Oregon;
2. The City Engineer prepare a report as to the findings and
recommendations of such legalization; and
3. A public hearing be held on September 28, 1993, to consider said
findings and recommendations; and
4. All owners of property abutting the right-of-way considered for
legalization be notified in writing of said public hearing.
