Resolution No. 93-14A IMF CITY OF TIGARD, OREGON RESOLUTION NO. 93- A RESOLUTION TO APPROVE AN AGREEMENT REDEFINING SURFACE WATER MANAGEMENT (SWM) RESPONSIBILITIES BETWEEN THE UNIFIED SEWERAGE AGENCY (USA) AND THE CITY OF TIGARD WHEREAS, the Surface Water Management Program has been in effect since 1990, and WHEREAS, the Surface Water Management program has been reviewed by USA and the Cities within Washington County, and WHEREAS, it has been determined that the redefinition of respc,nsibiliti.es and sharing of revenue is in the best interest of the SWM program; and `:.'HEREI S; *_.ho agreement between USA and the City of Tigard may be,revised through resolution. NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: Section 1: The agreement with the Unified Sewerage Agency is hereby amended per Exhibit A attached to this resolution. The City shall be responsible for accomplishing the adopted Maintenance Work Program for all areas within its corporate limits, including within County Road Rights of Way, with the exceptions as noted in #2 and #3 below. The Work Program is as defined in Table 1-MO of the February 1990 Surface Water Management Plan, a copy of which is attached. Notes: a. The Work Program may be revised by the Agency Boyd of Directors from time to time, followingthe _� procedures defined in this Agreement. b. The Work Program defines that roadside ditch maintenance and thea-ntenance of "bridges" is the responsibility of the "Road Fund". "Bridges" include bridge structures and culverts 36" in diameter and larger. In County roads, these facilities would be the responsibility of the County to maintain. C. The Agreement in Section 1. K limits the City's responsibility for accomplishing the entire Work Program according to "budgetary limitations and to the extent that the City may be lawfully authorized to act". 2. The City shall not be responsible for storm and surfE°. e water facilities and programs within the Rights of Way of State Highways. t 3. The City shall not be responsible for the maintenance of regional j water quantity or quality facilities. These facilities shall be defined as a detention or retention facility, a constructed wetland or wet pond, or other similar facility, where the area of the facility itself is at least one acre, and shall also include those facilities as agreed to in writing by the Agency and City.
