Resolution No. 91-34 � F � t � CITY OF TIGARD, OREGON RESOLUTION NO. 91- iif A RESOLUTION ACCEPTING THE FINAL ENGINEER'S REPORT FOR THE IMPROVEMENTS IN THE LINCOLN STREET AND LOCUST STREET LOCAL IMPROVEMENT DISTRICT, ACCEPTING THE PROPOSED ASSESSMENT ROLL, DIRECTING NOTICE BE GIVEN, AND DIRECTING A PUBLIC HEARING TO BE HELD. WHEREAS, the Council created the Lincoln Street and Locust Street Local Improvement District and directed the improvements to be made by Ordinance No. 89-31; and WHEREAS, the improvements have been completed, a final accounting has been completed, and a final engineering report has been submitted; and WHEREAS, the final engineering report contains the final cost of $385,369.62 and an assessment roll showing the name of each property owner, the description of the property assessed and the amount of the assessment against the described property; and WHEREAS, Ordinance No. 85-40 provides that the property owners may object in writing and that each such objection shall state specifically the grounds for the objection; and WHEREAS, Ordinance No. 85-40 provides that the Council shall review the written objections at a public meeting. I "^- NOW, THEREFORE, BE IT RESOLVED. by the Tigard City Council that.: Section 1. The Council reviewed the final engineering report and the Council accepts the final engineering report as submitted. Section 2. That having reviewed the proposed assessments, the Council hereby directs that notice be given of a public hearing to be held on Tuesday, June 25, 1991, at 7:30 PM at, Tigard City Hall, 13125 SW Hall Boulevard, Tigard, Oregon 97223, to review any written objections filed with the City Recorder by 5:00 PM, June,25, 1991, at Tigard City Hall, 13125 SW Hall Boulevard, PO Box 23397, Tigard, Oregon 97223. The ordinance ordered the construction of st__reet and traffic signal improvements in accordance with the preliminary engineer's report, directed the request of bid proposals, and set forth the method of assessment and financing. Construction The improvements were constructed as two projects. The LID established methods of assessments for each project, defined as Section A and Section B. One project involved the construction of approximately 780 lineal feet of new, two-thirds width, street improvements to Lincoln Avenue, and approximately 200 lineal feet of half-street improvements to Locust Street. The design of the street improvements was performed by KPFF and the construction was performed by Construction Excavating, Inc. The second project involved the installation of a new traffic signal at Locust Street and Greenburg Road, and the modification of an existing signal at Mapleleaf and Greenburg Road. The design of the traffic signal was performed by Mackenzie Engineering Inc. and the construction was performed by Grasle Electric. The street improvements were completed in November 1990, and the signal improvements were substantially completed in March 1991. Modifications to the Mapleleaf signal have rot been completed at this time; however, the cost is known for the remainder of the work. It is anticipated that this work will be completed in one day within the next few weeks. r Mai Final Cost The final cost of the project is as follows: Section A: Street Improvements Design & Inspection $ 26, 025.13 Construction $196,360.12 Administration $ 19, 834.41 TOTAL COST $242,219.66 Section B: Signal Improvements Design & Inspection $ 17, 034.63 Construction $114, 084.07 Administration $ 12, 031.26 TOTAL COST $143,149.96 Final Assessment Final assessments have been computed in accordance with Ordinance No. 89-31 on the basis of floor area of commercial buildings. The assessment roll includes a total of 10 benefitted tax lots. Two new tax lots now appear in addition to the preliminary engineer's report. Tax lot 35AB 0700 is a newly created lot containing the new parking structure. Tax lot 35AB 1006 has be partitioned from tax lot 35AB 1003 and contains the SeaFirst structure. The preliminary engineers report indicated the total square footage for each tax lot and stated that the square footage of commercial floor area was to be fixed at the time of application. It was intended that any changes to the buildings after the LID formation would not change the assessment percentages. Therefore the floor areas shown in the Preliminary Engineer's Report have been used in calculating the final assessment. In addition to the costs of the project as determined by the engineers report and reflected in the final assessment roll, financing costs as related to long term financing will be added to the assessments on those parcels for which installment payment contracts are received.
