RESOLUTION NO, 90-33
A RESOLUTION CONCERNING THE CONVEYANCE OF A PORTION OF TRACT "A" OF MERESTONE
SUBDIVISION IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREC3N_
WHEREAS, A request has beer, received and filed with the city of Tigard for the
transfer of a SO foot wide access strip, which is part of Tract"A" of Marestone
Subdivision, to Lot 10 of that subdivision; and
WHEREAS, this portion of land was previously granted for public open space and
utility purposes and is currently unimproved; and
WIMRZAS, the Tigard City Council finds it necessary and desirable to transfer
this portion of Tract "A" to Lot 10.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
(1) The city Council finds that the property transfer is appropriate and
conslatant with Section 3.44 of the Tigard Municipal code.
(2) The Tigard City Council approves the transfer of the 10 foot wide
access of Tract-A" to Lot 10 of Merestone Subdivision, a3 illustrated in
Exhibit "A", with the understanding that the existing easement for the
purpose of constructing and maintaining storm drainage, sanitary sewers,
potable water supply, and utilities Shall be retained.
(3) The City staff is hereby authorized and directed to complete this
Property transfer and to have the appropriate documents recorded with
Washington County.
