WHEREAS, Tigard Promotions Inc. (TPI) is sponsoring CnAsin' lixfard W9. a One
day event to be held on July 22, 1,969, and
WHEREAS. in order to hold this community e"nn the City, in cmWHaMO with
the Tigard Munic4p,.il Code, grants to 1P1 spocial permission for the following.

Section 1. use

use amplified sound between the hours: of 9 am and 6 pm on
Saturday, july 22, 1QG9, during the Gruisin' Tigard '09 event
Oar Main Street, between ScoffAw Street and Fampo Greek, in Me
City of Tigard. IPI shall provide to the City, as a
requirement of the City's J"jwrary Use Pe""t, a list of
booths using amplified sound during the downtown event. This
list shall include 1- cation of the bOOM(s) and times) Of
operation.
TPI and its agent(s) may use amplified sound between the hours
of 7 pm and 12 Midnight an Saturday, July 22, 1969, during the
'50s/'60s dunce at Cook Park in Tigard. It in understood that
ampliVi*d sound will be used between We hours of 7 pm and 8 pm
for recorded music, and that the Hard Tops band shall commence
playing no earlier than 8 pm and shall cease playing promptly
at 12 am (Midnight) On Saturday, July 22, 1989.
The permit authorized by this section doe=not give 11>1 and iti
agent(s) the right to cause or permit sound to emanate from
Cook Park so as to cause the ambient noise level at the nearest
noise--sensitive property to exceed 55 DBA. after the hourc?f 11
Section V Parks t,WnLM and det"rati-vQ—gevices (7.52.090). TPI and
Ns agent(s) may construct a temporary fence or barrier on the
grounds of Cook Park in the area of the main parking facility
and sport court, adjacent to the soccer fields, for the purpose
of securing the area to comply with Oregon Liquor Control
Commission (OLCC) regulations and requirements. It is Further
requested, as a requirement Of this permit, that TPI and its
agents construct a temporary fence/barrier in the area adjacent
to the restrooms and covered area #1 so as to attempt to
prevent persons from falling down the embankment which leads to
the. Tualatin River,

Section 3. Intoxicatinqlic�uor• (7.52.100). It is unlawful for any person
to take into or upon any park any intoxicating liquor, for
other, than his own use. -i-PI and its agent(s), however-, may
sell and dispense malt beverages, containing not more than 4
percent of alcohol by weight, during its beer- garden and
'50s/'60s event, between the hours of 7 pm and 12 11idnight, on
Saturday, July 22, 1969, in the area of Cook Park designated to
be used by TPS and its agent(s) for the above mentioned event.
This approval is contingent upon the required written approval
of the OI_.CC in the form of an OLCC permit.
Section 4. Permit (7.52.230). FPI and its agent(s) may use the main
parking area, sport court area, and restrooms!covered area #1
of Cook Park: for the purposes of the '5 Q'60s dance, beer
gardens, food and soft drink concessions, during the hours of 7
par and 12 Midnight, on Saturday, July 22, 1989. Permission to
use Cook Park is granted contingent upon approval from the.
Tigard Police Department that TPI and its agents) have
provided a security plan for the event which is acceptable to
the Tigard Police Department.
It is understood that some time prior to and some timo
following the abovo times will be needed for setup and tear
down/cleanup. For that reason, TPI and its agant(s) may access
the above mentioned areas for purposes of setup and tear
down/cleanup prior to 7pm on July 22, 1989 and after 12:01 am
on July 23, 1989. TPI and its agents) may not, however,
interfere with or cause hardship upon any group or person(s)
rigl,tfu.ly entering or using Cook Park on July 22 and 23, 1989.
It is further understood that FPI and its ager.t(s) are
responsible for the care of Qook Park during the hours of its
use by TPI and its agent(s), and that TPI and its agent(s) will
be responsible for cleanup of Cook Park following the event,
and that TPT and its agent(s) will be held liable for any
damage to Cook Park which may result from use of Cook Park for
this event.
Section 5. TPI and its agent(s) may conduct a parade between the hours of
10 am and 12 Moon, on Saturday, July 22, 1439 in conjunction
with the Cruisin' Tigard '89 event. This permission is given
with the understanding that TPI and its agents) will provide,
as a requirement of the City's Temporary Use Permit, copies of
necessary written approval(s) of businessos and State agencies
which may directly or indirectly be affected or inconvenienced
by the parade. 0etermination of those businesses./agencies
requiring written approval(s) will be made by City staff.

Section 6. TPI and its agent-(s) may designate, for additional parking
during the Cruisin' Tigard '89 morning event, the area of the
City's parking lot which is adjacent to the Tigard Civic.
Center. This area shall be referred to as the "landscape
unimproved" portion of the parking lot. The City will provide
to TPI and its agent(s) barricades which IPI and its agent(s)
may place at the erntrance/exit: areas in the early morning hours
of Saturday, .July 212, 1989.
The use of the City'; parking facility shall .in no way conflict
with nor impede the normal business routine, for which this lot
is intended (that is, to condi-ct City business). TPI and. its
agent(s) will abide by any rules and/or regulations which
govern the use of this parking area.
Section 7. l'PI may purchase on the City's insurance policy a rider for
both the morning and evening Cru.isin' Tigard '89 event.
Adequate coverage for TPS will be determined by the City. This
Process is provided to TPI as a courtesy and ir; no way reflects
,any responsibility or liability on the part of the City for the
event.
Section S. TP7and its agent(s) are hereby granted these special permits
with the understanding that all requirements for a _Temporary
Use Permit will be met prior- to July 22, 1989.
Section 9. ordinances_and.._rulation_ l,7-`,7.250). All permits
issued to TPS acid its agents) are subject to the City's
ordinances. TPI and its agent's) are bound by the rules,
regulationzs arid ordin mess as fully as though the sarn�• were
inverted in such permits. T'PI and its agent(5) shall. be liable
for any loss damage or- injury sustained by any person whatever
by reason of the negligence of the person or persons to whom
such parmit shall be issued, as well as for any breach of such
rules, regulations and ordinances, to the person or persons so
suffering &aimAges or injury.
Section 10. Attached Exhibits A, 8, arid C are recoranized as documents
pertinent to the granting of the above special permits and are
hereby submitted as part of this official document.

SUBJEC(: CRUISIN' TIGARD
On Monday, ;lune 25, 1989, Dave roglio and Steve Ogden will appear before
Council to update you on Cruisin' Tigard 1989. I have listed below
information regarding specific requirements for the event from the Tigard
Municipal Code. I will not address specifically the Temporary Use Permit for
the daytime event; Deborwh Stuart is processing that. information.
1. TPI wishes to use Cook Park for the beer gardens and dame the evening of
July 22. In order to comply with code, the following requirements must be
met.
EVENTS USING AMPI..IFIED SOUND
7:40.210 Permits required fo_r certain events. (a) The use of
amplified voice and music at levels which would otherwise exceed those
permissible under Sections 7.40,230 through 7.40.200 may be allowed upon
application to the city administrator. Application for an amplified sound
permit shall be made to the city administrator on forms prepared by the
city. The applicant shall identify the date, location, and time of the
event for which the permit is sought, and shall provide an estimate of the
duration of the event.
(c) The city administrator shall grant a permit in any instance in
which the event and its accompanying noise will not, in his judgment,
interfere unreasonably with the peace of those likely to be affected by
the noise. In making this judgment, he shall take int:> account the nate rsl
of the surrounding properties and the benefit to the community of thm
event for which the application is made.
(d) The city administrator may submit any question arising with
respect to this section to the city council, and if any irertrber of the city
council requests its submission to the council, any Toch question =hall be
heard by the council. In either event, the decision of the city council
shall be final.
(e) No permit authorized by this section shall give the applicant
the right to cause or permit sound to emanate from the property on which
the event is held so as to cause the ambient noisp level at the nearest
noise—sensitive property to exceed fifty—five DBA after the hour of eleven
p.m. (Ord. 88--20 Section 4 (Exhibit C(4) (7)), 1985).

unlawful for any person to place or carry any structure, sign, bulletin
board or advertising device of any kind whatever- or erect any post or, pole:
or the attachment of any notice, bill, poster, sign wire, rod or curd to
any tree, shrub, fence, railing, fountain, wall, post or structure, or,
place any advertising, decorative or other device of any kind whatever, on
any of the vases, statues, bridges or, i:ionuments in any park; provided,
that the city administrator may by a written permit allow the erection of
temporary decoration on occasions of public celebration or holidays.

7.52.100 Parks---Intoxicating__1_?.q�pr__prohib:�ed. It is unlawful for

other than his own use. No intoxicated person shall enter or remain in
any of the parks. The sale or dispensing' of malt beverages containing not
more than four percent: of alcohol by weight, shall be allowed only after
obtaining a permit to do so from the city administrator, upon
recommendation of the police chief, and appr_val of the: Oregon Liquor
Control Ccnimission. (Ord. 8y--48 Section 1, 1984: Ord. 71-12 `_action
3(4), 1971).
7.52.230 Permit_-Ro_quired. Use of the public areas herein described
for organized group picnics, political or religious gatherings, or gi•or(s
consisting of more than twenty—five persons in attendance .=:t any one time,
is unlawful unless a written permit has been issued with the approval of
the city administrator or recorder. (Ord. 82--62 Section 3, 1982, Ord.
71-12 Sectiion 3(1), 1971),
7_.52.250 , Permit.-- _t to_ordinances and regulations. All permits
issued by the city shall LO subject to the city's ordinances. The persons
to whom such permits are issued shall be bound by the rules, regulations
and ordinances as fully as though the same were inserted in such permits.
Any persor,. or persons to whom such permits shall be issued shall be liable
for any loss, damage or- injury sustained by any person whatever by reason
of the negligence of the person or persons to whom such permit shall be
issued, as well as for any breach of such rules, regulations and
ordinances, to the person or persons so suffering damages or injury.
(Ord. 71-12 Section 3(18), 1971).
2. Special permits required for the parade are as follows:
10.32.070 Permits re wired for parades. No procession or parade,
except a funeral procession, the forces of the United States armed forces
and the military forces of this state, shall occupy, march or proceed
along any street except in accordance with a permit issued by the chief of
police. Such permit may be granted where it is found that such parade is
not to be held for any unlawful purpose and will. not, in any manner tend to
a breach of the peace, cause damage or unreasonably interfere with the
public use of the streets or the peace and quiet of the inhabitants of
this city. (Ord. 70-41 Ch. 8 Section 7, 1970).
The Police Department has been kept exp—to—date: on progress made by TPI
regarding the beer gardens. TPI has yet to contract for security services for
the event. when a firm has beer: selected, the Police Department will
undertake an investigation of each security officer.

Dear Mr. Reilly,
This letter specifically addresses our proposed use of Cook park
in conjunction with the community celebration known as CRUISIN'
TIGARD 189. During the evening of July 22nd, we propose to have
a 060s/'60s dance combined with a beer garden (complete with food
and soft drink vendors) to close out this year's event. Such an

1985. This is the first time we have sought to use Cook Park for
the event, though prior to 1985 the park proper was used for the
community's festival which las known as: Town and Country Days.
We have reserved the park from 6:00 p.m. until 12:00 a.m. and
paid the required fee. We will commence clean-up of the site and
the nearby parking areas early on Sunday morning July 23rd.

We have contracted with Event Services, Inc.. to serve beer, and
possibly wine, at this site. The appropriate O.L.C.C. permit
application will be submitted to the City for signature as owner
of the property. We anticipate this will be prepared by June
30th. This event is a family activity as permitted under
O.L.C.C. regulations.
Event Services sub-contracts directly for the private security to
be used. At present, I do not have the required information on
this subject as another TPI Board Member is responsible for our
relationship with Event Services. Details will be forthcoming
very soon. As a supplement to the private eecurity firm, we have
utilized Tigard Police Reservists whenever possible.

Thearea itself is fenced off for the event with sanitation
facilities and trash receptacles on site. Lighting will be
provided around the perimeter and in the vending areas. It would
be appreciated if the public restrooms adjoining Group Site #1 at
the park are left unlocked for the evening. No other such
facilities should be left unlocked past normal park hours.
Event. Services carries liquor liability insurance coverage for
their activities in the minimum amount of $1,000,000 per
incident.. The insurance rider which TPI obtains through the
City's liability carrier provides additional coverage. We obtain
this with City approval and pay for the cost involved.
In the interest of the public's safety, it is suggested that a
uniformed police officer (perhaps a Reservist) direct traffic
during the evening (from approx. 6:30 p.m. ) at the intersection
of S. W. 92nd Ave, and Durham Road. Attendance at the dance is
estimated at approx. 1200-1500 total. The figure quoted is peak
attendance. Many travel 3-4 per car, so ample parking is not a
problem. By no means do all of them come early and stay for the
entire evening. Since we are some distance from the downtown
area, where daytime activities are focused., attendance might even
be less. Our past dances have all been within easy walking
distance of S. W. Main Street.
With regard to visitor parking, we have already arranged with
Tigard High School for use of their parking lots for our evening
patrons. The paved lot adjacent to the Mead Field soccer area
will be used for parking "show stars", our evening vendors, the
band, any police vehicles, and TPF personnel. The issue of
parking along the westside of S. W. 92nd is a concern since it is
posted NO PARKING. We seriously doubt it is possible to enforce
this. Also, we will do our best to prevent our patrons from
parking along the residential side streets off 92nd between
Durham Road and the park.
We realize that TPI will need to provide adequate personnel to
insure that no one parks near the gate entrance on either side of
the road or states for that portion not on a level grade. With
the City's concurrence, the level area of 92nd inside the states
should permit parking along its east side only (outbound from the
park).
Another item that must be addressed is locking the gates to Cook
Park once the dance is over at midnight. It takes approx. 1f2
hour for those present to leave and the band's minimum "load out"
time is 1 1/2 hours. How do we handle this? Also, the park
customarily opens at 8:00 a.m. If we elect to commence clean-up
at 7 a.m. (or earlier) on the 23rd, can we gain access? It is
preferable to get an early start.
Since you arm in your first year as Tigard's City Administrator
and have not seen our festival, it seemed wise to provide you
with an overview of the evening's activities. We look forward to
your response to our requests. You may be assured that we will
follow through on any unresolved matters.

Dear Mr. Reilly,
This is the first of several specific requests that will be directed to
you regarding this sumuier's cormunity-wide festival which is scheduled
for July 22, 1989. This particular request is sent to you in your capacity
as Acting Chief of Police.
In conjunction with this event, Tigard Promotions, Inc. hereby requests
authorization from the City Police to conduct a parade as noted above, and
to provide a "police lead" for said parade. The parade is being staged
from two (2) locations: (a) the parking lot adjoining Nelsen's Tire
Warehouse near the intersection of State Highway 99W and S. W. McDonald St.
[13400 block], and (b) the Tigard Marketplace [13500 block].
The parade will proceed in a northerly direction along the east side of
99W to the intersection with S. W. Main Street (opposite St. Anthony's
School). At that point, it will leave the highway and continue along
Main Street to rh: 2j_.chand arca _ the ri_ry ._,f C W Scoffino St
(near the U. S. Bank branch and the local. McDonald's). A map of the pro-
posed Darade route is enclosed together with copies of letters directed
to the Oregon State Police and the Oregon State Highway Division.
Traffic control in the past has been coordinated with the Police Dept.,
the Police Reserves and our organization, Sgt. Chuck Martin, among others,
is familiar with this aspect. I am also enclosing a copy of the list
used last year in either siting an officer (or one of our people) at
various intersections, or barricading other intersections.
If you have any questions, please feel free to call me at 620-2451. Our
group is coordinating other permits through Ms. Deborah A. Stuart in the
