RESOLUTION NO. 89-�O
A RESOLUTION DECLARING THE INTENT TO FORM A LOCAL IMPROVEMENT DISTRICT TO
CONSTRUCT STREET AND UTILITY IMPROVEMENTS ON THE PACIFIC CORPORATE CENTER
PRnPER'TY AND TO HOLD A PUBLIC HEARING, ADOPTING THE PRELIMINARY ENGINEER'S
REPORT, AND LuRELiING THAT NOTICE OF THZE HEARING BE GIV22<.
WHEREAS, the City Council by Resolution No. 89-29 directed that a Preliminary
Engineer's Report be prepared for the construction of street znd utility
Improvement within the area bounded by Bonita Road, SW 72nd Avenue, Upper
Boones Ferry Road and Interstate highway 5, and
WHEREAS, the Preliminary Engineer's Report has been completed and submitted to
the Council together with a report from the Comm.Aiity Development Director,
which finds the proposed project to he feasible and recommends that the
distriot be formed.
NOW, THEREFORE, HE IT RESOLVED by the Tigard City Council that:
Section Y: The City Council by thia resolution declares its intention to
make street and utility improvements on the Pacific Corporate
Center property.
Section 2: The City Council by this resolution: declares its intention to
form a local improvement district with boundaries as described
in the legal description contained within the appendix to the
Preliminary Engineer's Report attached as Exhibit A.
Section 3: It is the intention of the City Council that tha .improvements be
constructed in accordance with the Preliminary Engineer's Report
attached as Exhibit A and entitled "Preliminary Engineering
Report, Pacific Corporate Center L.Z.D.". The report may be
changed in the hearings and is hereby adopted subject to
amendments.
Section 4: The total estimated cost i.s $2,126,166 for the proposed
improvements and the benefitted properties shall be assessed on
an area basis to arrive at a fair apportionment of the costs
among the specially benefitted properties.
Section 5: The Improvements shall be constructed by competitive bid.
Section 6: A public hearing shall be held at Tigard City Hall, 13125 SW Hall
Boulevard, Tigard, Oregon on the 22nd day of Flay, 1989,at 7:30
P.M., at which time the City Council will hear objections or
remonstrances to the proposed improvement by any property owner
within the proposed local improvement district boundary.

Section 7: At least ten days prior to the public hearing, the community
Development Director is directed to give notice of the public
hearing by publication and by individual mailed notice to all
owners of real property affected by the proposed improvements.
Section 8: All remonstrances shall be filed with the City Recorder by the
close of the initial hearing. Thereafter, no remonstrances shall
be considered except as otherwise provided by ordinance No. 85-
40.
