A RESOLUTION DIRECTING STAFF TO HAVE PREPARED A PRELIMINARY ENGINEERING REPORT
REGARDING THE FEASIBILITY OF PROVIDING STREET AND UTILITY IMPROVEMENTS THROUGH
THE FORMwTION OF A LOCAL IMPROVEMENT DISTRICT IN THE AREA OF TU PROPOSED
PACTRUST DEVELOPMENT.
WHEREAS, the City Council has received a petition stating interest in the
formation of a Local Improvement District to provide street and utility
improvements; and
WHEREAS, the area to be Included within th3 proposed Local Improvement District
is generally the properz£es .rwned by PacTrust Realty Inc. within the area
bounded by Bonita Road, SW 72nd Avenue, Upper Boones Ferry Road, and Interstate
Highway 5; and
WHEREAS, the City Council has reviewed and accepted the preliminary evaluation
report entitled 'Preliminary Evaluation Report, PacTrust LID' which was
submitted by the Community Development Director, and which recommends approval.
NOW THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 3: Staff is hereby directed to have prepared a Preliminary
Engtneer,s Report in accordance with TMC 13.04.030(b),
considering the installation of public street and utility
improvements to serve the area bounded by Bonita Road, SW 72nd
Avenue, Upper Boones Ferry road, and Interstate Highway 5,
subject to the conditions of Section 2 of this resolution.
Section 2: All costs of preparation of the preliminary engineer's report
shall be borne by the petitioner, PacTrust Realty Inc. No work
shall be commenced by the City until the petitioner has
guaranteed paym&nt of such costs.
