Resolution No. 89-25 CITY OF TIGARD _ RESOLUTION NO. 89- A RESOLUTION CONCERNING THE DETERMINING OF, AND SALE OF CITY SURPLUS REAL PROPERTY K24OWN AS TRACT -C", PATHFINDER , A RECORDED SUBDIVISION PLAT, LOCATED IN THY. CITY OF TIGARD, WASHINGTON COUNTY, OREGON WHEREAS, Tracts A,B and C, Pathfinder subdivision, were conveyed to the City for easement and greenway purposes; and WHEREAS, Tract G appears to no longar aerve any City or public purpose; and WHEREAS, an adjoining property owner has expreseed interest in acquiring Tract Cy and WHEREAS, the Park Board has reviewed the proposal and determined that the property is net desirablo to fulfill the ncedc of the Parke Closter Plan; and WHEREAS, Tract C is elassifiad as Substandard Undeveloped Property as defined at TMC 3.44.005(a); and WHEREAS, -,:he Tigard City Council finds it desirable and necessary to declare said property, City Surplus real property. NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that; _ (1) The Tigard City Council declares the above described real property surplus and initiates the process by which to sell Substandard Undeveloped Property as descr:Lha.d in THC 3.44. (3) That the minimum acceptable terms for the sale of said real property shall be ae followsa (a) The minimum bid shall not be less than 1 dollar. (b) Buyer will pay 50% of any transfer or escrow fees associated with this purchase. (c) The successful bidder may not use the purchased property for any use that violates applicable zoning and comprehensive plan regulations and other applicable laws including minimum lot size and setback requirements. (3) That the Finance Director be, and he is hereby, authorized and directed to cause to have published in the Tigard Times, a newapaper of general circulation in the City of Tigard hereby desigr_ated for such purpose, a notice requesting sealed bids for the sale Of said property, the first and only publication to be on M ;1989.
