RESOLUTION NO. 89-�
A RESOLUTION CONCERNING THE DETERMINING OF, AND SALE OF CITY SURPLUS REAL
PROPERTY KNOWN AS TRACK.' "G^, GENESIS NO. 3 A RECORDED SUBDIVISION PLAT,
LOCATED IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON
WHEREAS, Tract G, Genesis No. 3 subdivision, was conveyed to the City for park
playground purposes; and
WHEREAS, the Park Board has reviewed the proposal and determined the property
is not desirable to fulfill the needs of the Parks Master Plan; and
WHEREAS, Tract G appears to no longer serve any City or public purpose; and
WHEREAS, an adjoining property owner has expressed interest in acquiring Tract
G; and
WHEREAS, Tract G is classified as Substandard Undeveloped Property as defined
at T.VC 3.44.005(a); and
W-HERE_AS, the Tigard City Council finds it desirable and necessary to declare
said p=op3rLy, City surplus real property.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council than_;
(1) The Tigard City Council declares the above described real property
surplus and initiates the process by which to sell Substandard
Undevaloped Property as described in TMC 3.44.
(2) That the minimum acceptable terms for the sale of said real property
shall be as follows:
(a) The minimum bid shall not be less than 1 dollar.
(b) Buyer will pay 50% of any transfer or escrow fees associated with
this purchase.
(c) The successful bidder may not use the purchased property for any
use that violates applicable zoning and ccmiprehensive plan
regulations and othe_- applicable laws including minimum lot size
and setback requiremants.
(3) That the Finance Director be, and he is hereby, authorized and directed
to cause to have published in the Tigard Times, a newspaper of general
circulation in the City of Tigard hareby designated for such purpose, a
notice requesting sealed bids for the sale of said property, the first
and only publication to be on '.-ave* -0,1989.
