RESOLUTION NO.
A RESOLUTION ESTABLISHING^ A POLICY FOR SINGLE OWNER LOCAL IMPROVEMENT DISTRICTS
WHEREAS, the City receives, from time to time, requests to form a local
improVO-ant district in which there would be only one property owner involved;
and
WHEREAS, the City wishes to clarify the conditions under which they would be
receptive to tt.a_ formation of a single owner local hv.provement district; and
WHEREAS, the Cit;; Council discussed its proposed policy at its raetings of
December 12, 1988 and January 13, 1989, and directed staff to draft a written
policy statement formalizing the oral decision of the Council.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that the City will
consider requests for the formation of local improvement districts in which
only a single property owner is involved;
BE IT FURTHER RESOLVED that such requests will be considered on a case-by-case
busis, as an exception to normal City policy, and only under the conditions
described below as a inl u .
Section 1: The property is zoned and proposed to be used for industrial,
commercial or office development;
Section 2: The applicant demonstrates the "Public Purpose" involved, which
may include the creation, of jobs in the co-mmunity.
Section 3: The applicant demonstrates that the rzk to the City government
or the general taxpayer is minimized. As a guideline, the City
Council will request the following:
a. That the applicant provide an appraisal of the property
affected, such appraisal being done by an appraiser
acceptable to the City Administrator;
b. That the amount to be assessed against the property not
exceed 25% of the appraised value of the land only,
excluding any improvements to the property;
C. That financial documents be provided as required to the
City Administrator which can demonstrate that the property
owner has financial ability to pay the assessments levied
on the property.
