WHEREAS, King City desires to contract with l-igard for the provision of police dispatch ser'vic'es and nor the provision of police response services to emergency calls when King City has no personnel on duty; and WHEREAS, i igarYJ - ayr___ LC ,�(_. NOW THEREFORE, in consideration of the mutual promises and covenants herein contained, it is mutually agreed as follows: i.0 DUTIES OF TIGARD REGARDING POLICE DISPATCH: 1.1 Tigard shall provide a dispatch center with sufficient- labor .and supervision to dispNici, io nany City r;yq"o:;t:; fur service wit'r,in the King City —rpur'&t0 111-1-1<<.. 1.2 Tigard shall operate and maintain its radios on the frequencies assigned to Tigard Police and shall maintain other equipment and supplies as may be. necessary to provide dispatch sErvicess. 1,3 Tigard shall dispatch accurate and complete incident information to King City law enforcement personnel as received by the dispatch center from both emergency and non--emergency requests for police service. 1.4 -ri.gard shall alertand/or dispatch additional cover units from King City or <Adjacent departments as requested or required. 1.5 Tigard shall continuously monitor the status of King City in--service units and monitor their welfare at the scene of potentially dangerous situations. 1.6 Tigard shall provide King City Police Officers with direct and immediate access to information from local, state, and national law enforcement computer data systems to obtain or determine: 1.5.1 Wanted status on subjects and/or vehicles. 1.5.2 Vehicle registration information. 1.5.3 Driver's license information. 1.5.4 Computerized criminal history information. 1.7 Tigard shall verify by telephone or radio, anywhere in the United States, the accuracy of information concerning arrest warrants and stolen vehicles and property, and shall enter sufficient information into Law Enforcement Data System (LEDS) indicating that an arrest has been made, or that vehicles or other property has been seised. AGREEMENT FOR POLICE SERVICES -- PAGE 1 1.8 -rigar'd shall provide a 24 hour continuous time recurding of the radio a ndt�lupliono communications in the dispatch center and shall assure t ha recordio'j tapLs , ,� And mazntax :<d for- a minimum or iuC; days. 1.9 -1igard shall act as communications intermediary among Kiny City law enforcement officer's, other• law enforcemorit agencies, and other emergency services provider's as required. 1.10 Tigard shall make telephone calls for King City Police personnel as rc?gn0.•-ert in aid at the scene of law activities. 1.11 Tigard shall retain control of the rendition of dispatch services, the: standards of performance, the discipline of dispatch pvr-sonne.l, and other matters incident to dispatch services. 1.12 All persons employed in t:he performance of dispatch services; and functions pursuant to this Agr'eemont shall be Tigard umployeos. No person employed in the por•for'mance of dispatch services shall have any King City salary, pension, or- other ststus or right under the provisions of King City employment practices or, policies. 2.0 DUTIES OF KING CITY REGARDING POLICE DISPATCH 2.1 King City shall provide the Tigard police Dispatch Center- with - descr•iption of the corporate boundaries of King City and shall immediately advise the ligand Police Dispatch Centerconcerning any changes in such boundaries. 2.2 King City shall provide l"igard police Dispatch Center with written operating procedures for the appropriate handlinca of all King City law enforcement related calls. 2.3 King C;ty shall keep Tigard Police Dispatch Center advised at all timeas to the area of responsibility and status of Kind City law enforcement personnel for police matters. 2.4 King City shall provide Find maintain atits own expense adequate radio receiving equipment, to permit the reception of ca:iis from the Tigard Police Dispatch Center to King City Police units and personnel. 2.5 King City shall provide and maintain at its own expense adequate telephone equipment on a seven digit telephone number for the handling of non—emergency telephone requests for police assistance directed to King City, 2.5 King City shall provide an additional phony line to the Tigard Police Dispatch Center if deemed necessary by mutual agrc.-oment of the parties to this Agreement. !.7 King City shallVresponsible for arty salaries, wages, or any other compensation duo to injury or sickness of any Tigard employee. 2.8 King City shall furnish and supply all necessary labor, supervision, equipment, and supplies necessary to maintain and carry out the ( duties of King City as herein described. SERVICES -- PAGE 2 3.0 DUTIES OF TIGARD REGARDING RESPONSE TO EMERGENCY CALLS 3.1 the Tigard Police Department shall respond to emer.Iency calls when King City Police personnel are not on duty. 3.2 -Rte emergency police services provided by Tigard shall encompass the duties and enforcement functions of the type coming within the jurisdiction of, and c"tomarily rendered by, a King City police officer responding to similar• emergency calls. 3.3 (a) F—opt as otherwise provided in subsection (k.), -ligard shall retain control over the rendition of the sorvices describeci io i.ni� n.. . c ac„ the standards of performance, the discipline of officers, and other' matters incident to the performance of such services and control of personnel so employed. 3.3 (b) In the event King City law enforcementis dispatched to an emergency CUL such personnel shall immediately take control of the scone upon arrival. and ligard police personnel may render- assistance as requested by King City per•sortnel. 3.4 For the purpose of poeTorming said functions, Tigard shall furnish and supply all necessary labor, supervision, equipment, •mu munication F-rilities and supplies necessary to maintain the level of services W be rendered under this Agreemont. 3.5 Tigard shall make available for Ow performance of the duUct;- described in this Agreement., a properly supervised officer or officers, duly certified by the Oregon Stat: B"A on Police Standards and Training. 3.6 -the Tigard Police chief shall be responsible for assigning sufficient officers to respond to emergency calls in King City during the time that King City personnel are noton duty. 3.7 Tigard Police Department personnel responding to emergency calls for the benefit of King City shall remain ligard employees and shall not have any King City salary, pensions, or any status or rights under any provision of King City employment. 3.8 Tigard agrees that at .all times during the terns of this Agreement, Tigard shall secure, maintain, and keep current a policy or policies of insurance with public liability, collision, and comprehensive coverages on all vehicles owned by Tigard and used in connection with the provision of police services within the corporate limits of King City. Tigard shall also secure, maintain, and keep current a policy or policies of insurance covering professional liability for officers engaged in police services for the City of King City. Insurance limits shall be equal to limits applicable to coverage for Tigard police services within the corporate limits of Tigard. Insurance deductible exclusions shall be equal to those deducLible exclusions applicable to the provision of police service within the corporate limits of Tigard. Certificates of such insurance shall be provided to King City. 6 AGREEMENT FOR POLICE SERVICES – PAGE 3 4.0 DUTIES OF KING CITY REGARDING RESPONSE TO EMERGENCY CALLS 4.1 rhe King City Officer-in-Charge shall Pr•ovido to the Tigard Police_ a schedule of hours when no King City police personnel are on duty. 4.2 The King City Officer-in-Charge shall provide to the Tigard Police a list of any mututclly agreed upon special instr•ucti3Ons or- procedures that ligand Police mood to follow when responding to mergency ral.l.s in King City. 5,0 MUTUAL BOTILES OF TIGARD AND KING CITY REGARDING RESPONSE TO EMERGENCY CALLS 5.1 The Police Chief of Tigard and King City Officer•--in--Charge shall. mutually agree by written mamor•ancum as to what constitutes an emergency call. 5.2 The police: Chief of l-i.gard and King City Officer. irr-Charge shall mutually agree by wr•itLen momorandum as to what emorgency calls will require callirio out a King City Officer for, immediate. follow--up. 6.0 DISPUTES 6.1 An advisory con+mit.tc:e will be established with representation from King City Police, Tigard police, and Tigard Police Dispatch Centor. This committee shall be responsible far establishirng mutually acceptable operating procedures for the Dispatch Center. 6.2 Disputes or conflicts regarding the dispatch of King City police which cannot be handled at the shift supervisor•/suPPOrt services manager level, shall be resolved by mutual agreement of the Chief Of police of Tigard and Officer-in-Charge of King City. 6.3 Disputes Or conflicts regarding responses to emergency calls shall be resolved by the nsutual agreement of the Chief of Police of Tigard and Officer-in--Charge of King City. 7.0 PAYMENT 7.1 -Tigard will charge and King City will, pay �34T_50 per month for the police dispatch services described in 0octi.4sn 1 above. Operational costs of the Tigard Police � spa err' , 110-110-59 . d are ^ recall, an the number of calls for service to King City are 259 Calls per month. 7.2 Tigard will charge and King City will. pay 11_23 per response for all Tigard (lice responses to emergency calls when King City personnel are not on duty as described in sections 3 and 5 above. 7.3 payment for --,'ispatch services shall be made in advance on a monthly basis, the first payment to be made upon the 2xecuti.on of this Agrefemeiit and each additi.Oifal paytuetit to be made on the first day of each calendar month thereafter. Payment for emergency response service s +all be billed anti paid on a monthly basis for responses made in the prior month. Tigard shall not disrupt either dispatch or emergency call service for King City's failure to pay without 14 days written notice. AGREEMENT FOR POLICE SERVICES - PAGE 4 8.0 HOLD HARMLESS 8.1 ligar'd hereby covenants and agr"ees to hold and save King City, its off-icer-s, employees, and agents harmless from all claims whatsoever that may arise against King City, its officers, employees, or agents by reason of any act of Tigard, its officer's, employees: or agents in the performance of the duties required by the terms of this Agreement. 8.2 King City hereby covenants and agrees to hold and save Tigard, its officer's, employees, and agents harmless from all. claims whatsoever that may arise against Tigard, its officers, employees, or- agents by reason of any mact ming �:i iy_ ii o*, .. �.�s,_ „yEle3, or agents in y r. ca:p.. the performance of the duties require❑ by the teras of this (agreement. 8.3 Tigard and King City mutually covenant and agree that neither party will insure the actions of the other, but rather oach, party will assume its own responsibility in connection with any claims made by a third party against Ti:3ard and/or King City. 8.4 Tigard and King City agree that nothing contained in this Agreement is int dad to limit the remedy, if any, of either party against the other party, including claims under subrogation agreements with the parry hisurance carrier to recover for' ea a --js to property or injury to persons caus_v Ny .: T.: rt, ::uc:l iaenc•.e. 9.0 EFFECTIVE DATE AND RIGHT TO TERMINATE 9.1 Tigard and King City agree that this Agreementshall be effective for a period of one year, commencing at MiDNIGHT on the last day of June 1968 and expiring at MIDNIGHT on the last day of June 1989. In the event that either- Tigard or King City desires tc renew this contract upon the expiration thereof, the city so desiring shall notify the other city at least sixty (60) days prior to expiration of the Agreement. Within 30 days after receipt of such notice, the parties shall review the Compensation and any other provisions hereof, and agree to renew the agreement a, it may be modified. If agreement cannot- be reached, the contract will terminate as provided above. 9.2 This Agreement may be terminated by either party without cause upon thirty (30) days prior written notice. 10.0 WHOLE AGREEMENT 10.1 Other than as specifically described herein, this contract contains the entiro agreement between parties and supersedes any and all other agreements, written or oral, expressed or implied, pertaining to the subject matter hereof-. 10.2 This contract is subject to all applicable public contracting laws, municipal finance, and constitutional and charter debt limitations of the parties and of cities generally, and in subject to funds being appropriated therefore.
