DELE.-11ON OF A PORTION Of THE AUTHORIZED AME=NDMENT OF THE INIERrnvti_RNMEN'TAL COOPERATION AGRLLMLNI LttIwrtiv iiia METROPOLITAN AREA COMML1Ni:(;R.1I0NE: COMMT4SIOt1 AND 11-S MEMBER .T.L'.RIt:D1CT10NS WHEREAS, on the 14th day of March, 1988, the Tigard City Council passed Resolution No. 88-22; and WHEREAS, Resolution No. 68--22, in part, consented to and authorized the amendment of the Intergovernmental Cooperation Agreement between the Metropolitan Area Communications Commission (MACC) and its member jurisdictions (the proposed amendments set forth in Exhibit 4 to MACC Resolution 68-02); and WHEREAS, MACC and its member- jurisdictions have agreed that Section 2 of the proposed amendments, entitled "Distribution or Franchise s, should be deleted from the proposed amendments to the Intergovernmental Cooperation Ac,,omen t. NOW, THEREFORE, BE If RESOLVED by the Tigard City Council that: SECTION 1: The Tigard City Council hereby consents to and authorizes the deletion of Section 2. of the proposed amendments to the Intergovernmental Cooperation Agreement between MACC anti its member jurisdictions (Exhibit 4 to MACC Resolution 88--02), and further authorizes the corresponding deletions to the title, recitals, renumbering of sections, and the revised amendments attached hereto as Exhibit A. WHEREAS, pursuant to an "I-tergovernmental C000peration Agreement Metropolitan Area Communications Commission" (Agreement), the cities of Banks. Beaverton, Cornelius, Durham, Forest Grove, Hillsboro, King City, Lake Oswego, North Plains, Rivergrove, Sherwood, Tigard, Tualatin and Wilsonville, all municipal corpora- tions of the State of Oregon, and Washington County, a county formed under the laws of the State of Oregon, created a joint commission, known as the Metropolitan etrospecificoik Communications Cinmthe is- sion (MACC) to carry P ur Poses Agreement; and WHEREAS, Sec-tion 9.E. of the Agreement requires that its terms shall not be amended without the written authorization of the governing bodies of all the member jurisdictions; and WHEREAS, the governing bodies of the member jui isuici iv.io +nv= unanimously authorized amendment of the Agreement (1 ) to include within MACC's responsibilities the operation of access and local originationprogramming and to (2) authorize reimbursement to MACC of certain expenses, - NOW, THEREFORE, the Intergovernmental Cooperation Agreement - rtetropoiitar, Are,, Co^Mur_i_ations Commission is amended as follows: SECTION 1 . Section 3 of the Agreement is amended to add a second paragraph reading as follows: In addition to the powers set forth above, and in accordance with terms and conditions of the Cable Communications Franchise Agreement, as amended, the Commission shall be responsible for the operation of access and local origination programming. The Commission may contract with service providers as it deems necessary to meet this responsibility_ SECTION 2. A new section 6-D. is added to the Agreement as follows: D. The Commission is authorized to enter contracts as it deems appropriate for the review of the Grantee's revenue reports, on an annual basis or otherwise.
