RESOLUTION NO,
A RESOLUTION ACCEPI:IIUG PUBL.I:C I:MPROVEMENT'S KNOWN AS PENN LAWN ES`rATE:;
SUBDIVISION PUBLIC IMPROVEMENTS.
WHEREAS, the City executed a Subdivision Compliance Agr-e.ement dated
September 16, 1985, with Arthur- & Associates to facilitate installation of
public improvements (street, storm and sanitary sewers) to specified standards
and specifications; and
WHEREAS, said Compliance Agreement stipulated that:
"At such time as all public improvements have e n ,,.,';:plceted in ac<=ordance
with ther
City's requirements, petitioner shall notify the City of
readiness for, final inspection and upon certification by the Department of
Community Development that all requirements of the City have been met, the
Council agrees to accept said improvements, for, operation and maintenance
responsibility, and release the Petitioner's guarantee bond"; and
WHEREAS, Department of Community Development staff verifies that all.
requirements of the City have been met; and
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
The Tigard City Council hereby accepts the public improvements known as Penn
Lawn Estate Subdivision Public Improvements;
AND, FURTHER, the City Council hereby authorises release of the Petitioners
guarantee bond.
