A FINAL ORDER IN THE MATTER OF THE APPLICATION FOR TEMPORARY USE APPROVAL
REQUESTED BY AS TRO WESTERN COMPANY, FILE NUMBER TU 87-09, DENYING THE
APPLICATION, ENTERING FINDINGS AND CONCLUSIONS.
WHEREAS, the applicant requested a Temporary Use Permit approval for operation
of a used car lot on property zoned C--G (General Commercial) temporarily for a
period of up to one year; and
WHEREAS, the relevant approval criteria in this case are contained in
Section 18.140.050(c) of the Community Development Code; and
WHEREAS, the Tigard City Council heard the above application at its regular
meeting on August 3, 1987.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1: The site has continuously been in use as a temporary used car
sales lot since July, 1985;
Section 7: The Code allows extension of a one-year temporary use
application only once for a period of one year;
Section 3: Thatthis extension would represent the third consecutive year
of temporary auto sales on a temporary basis and a violation of
the Code;
Section 4: The Council, therefore, ORDERS that the above referenced
o request be, and the same hereby is, DENIED.
