Resolution No. 87-87 CITY OF TIGARD, OREGON RESOLUTION NO. 87—'8 A RESOLUTION OF THE TIGARD CITY COUNCIL RATIFYING A POLICE DISPATCH SERVICES CONTRACT BETWEEN THE CITY OF TIGARD AND CITY OF KING CITY. WHEREAS, the Tigard Police Department has received a request from the City of King City to provide police dispatching and police emergency response service to the King City Police Department; and WHEREAS, the Tigard Police Department and the City Council believe that providing this service is a key in improving the quality and quantity of inter—agency cooperation in the county and the region and will mutually benefit both cities. NOW, THEREFORE, 8E IT RESOLVED by the Tigard City Council that: Section 1: The Tigard Police Department provide police dispatching and Police emergency response services to the City of King City as detailed in the Tigard/King City Police Dispatch Services Agreement which is attached and referenced as Exhibit "A". Section 2: The Mayor and City Recorder are hereby authorized to sign the Tigard/King City Police Dispatch Services Agreement on behalf of the City of Tigard and the Recorder is further directed to file a copy of said agreement with the City of King City. Mayor — City of Tigard ATTEST: City Recorder — City of Tigard DCL:sb/004ft } s TIGARD/KING CITY POLICE DISPATCH AGREEMENT This AGREEMENT is made and entered into by and between the City of 'Tigard (Tigard), a municipal corporation for the State of Oregon, and the City of King City (King City), a municipal corporation for the State of Oregon. WHEREAS, King City desires to contract with Tigard for the provision of police dispatch services and for the provision of police response services to emergency calls when King City has no personnel on duty; and WHEREAS, Tigard is agrr)!eable to rendering such services on the terms and conditions hereinafter set forth; and WHEREAS, such contracts are authorized and provided for under ORS 190.010 et seq. NOW THEREFORE, in consideration of the mutual promises and covenants herein contained, it i.s mutually agreed as follows: 1.0 DUTIES OF TIGARD REGARDING POLICE. DISPATCH: 2.1 Tigard shall provide a dispatch center- with sufficient labor and supervision to dispatch to the King City Police Department requests for service within the King City corporate limits. 1.2 Tigard shall operate and maintain its radios on the frequencies assigned to Tigard Police and shall maintain other equipment and supplies as may be necessary to provide dispatch services. . 3 Tigard shall dispatch accurate and complete incident information to King City law enforcement personnel as received by the dispatch center from both emergency and non--emergency requests for police service. 1.4 Tigard shall -cand/or dispatch additional cover units from King City or adjacent departments as requested or required. 1.5 Tigard shall continuously monitor the status of King City in--service units and monitor their welfare at the scene of potentially dangerous situations. 1.6 Tigard shall provide King City Police Officers with direct and immediate access to information from local, state, and national law enforcement computer data systems to obtain or determine: 1.5.1 Wanted status on subjects and/or vehicles. 1.5.2 Vehicle registration information. 1.5.3 Driver's license information. 1.5.4 Computerized criminal history information. 1.7 Tigard shall verify by telephone or radio, a.raywher-e in the United States, the accuracy of information concerning arrest warrants and stolen vehicles and property, and shall enter sufficient information into Law Enforcement Data System (LEDs) indicating chat: an arrest has been made, or that vehicles or other property has been seized. AGREEMENT FOR POLICE SERVICES — PAGE 1 F 1.8 Tigard shall provide a 24 hour continuous time recording of the radio and telephone communications in the dispatci; center, and shall assure that recording tapes are stored and maintained for a minimum of 180 days. 1.9 Tigard shall act as communications intermediary among King City law enforcement officers, other law enforcement agencies, and other emergency services providers as required. 1.10 Tigard shall make telephone calls for King City Police personnel as required to aid at the scene of law enforcement activities, 1.11 Tigard shall retain control of the rendition of dispatch services, the standards of performance, the discipline of dispatch personnel, and other- matters incident to dispatch services. 1.12 All persons employed in the performance of dispatch services and functions pursuant to this Agreement shall be Tigard employees, No person employed in the performance of dispatch services shall have any King City salary, pension, or other status or right under tho provisions of King City employment practices or policies. 2.0 DUTIES OF KING CITY REGARDING POLICE DISPATCH 2.1 King City shall provide the Tigard Police Dispatch Center with a description of the corporate boundaries of King City and shall immediately advise the Tigard Police Dispatch Center concerning any changes in such boundaries. 2.2 King City shall provide Tigard Police Dispatch Center with written operating procedures for the appropriate handling of all King City law enforcement related calls. 2.3 King City shall keep Tigard Police Dispatch Center advised at all times as to the area of responsibility and status of King City law enforcement personnel for police matters. 2.4 King City shall provide and maintain at its own expense adequate: radio receiving equipment to permit the reception of calls from the Tigard Police Dispatch Center to King City Police units and personnel. 2.5 King City shall provide and maintain at its own expense adequate telephone equipment on a seven digit telephone number for the handling of nom-emergency telephone requests for• police assistance directed to King City. 2.4 King City shall provide an additional phone lin, to the Tigard Police DispaLch Cer,t.ur if deemed necessary by mutual agreement: of thr, parties to this Agreement. j 2.7 King City shall not be responsible for any saiaries, wages, or any other compensation due to injury or sickness of any Tigard engploye<�. �. 2.8 King City shall furnish and supply al.1 necessary labor, supervision, equipment:. and supplies necessary to maintain and carry outthe duties of King City as herein described. AGREEMENT FOR POI.TC1- SERVICES — PAGE 2 j k; 3.0 DUTIES OF TIGARD REGARDING RESPONSE TO EMERGENCY CALLS 3.1 The Tigard Police Department shall respond to emerrenc. 9 y calls when King City Police personnel are not on duty. 3.2 The emergency police services provided by Tigard shall encompass the duties and enforcement functions of the type coming within the jurisdiction of, and customarily rendered by, a King City police: officer responding to similar emergency calls. 3.3 (a) Except as otherwise provided in subsection (b), Tigard shall retain control over the rendition of the services described in this section, the standards of performance, the discipline of officers, and other matters incident to the performance of such services and control of personnel so employed. 3.3 (b) In the event King City law enforcement is dispatched to an emergency call, such personnel shall immediately take control of the scene upon arrival and Tigard police personnel may render assistance as requested by King City personnel. 3.4 For the purpose of performing said functions, Tigard shall furnish and supply all necessary labor, supervision, equipment, communication facilities, and supplies necessary to maintain the level of services to be rendered under this Agreement. 3.5 Tigard shall make available for the performance: of the duties described in this Agreement, a properly supervised officer or officers, duly certified by the Oregon Statc: Board on Police Standards and Training. 3.6 The Tigard Police chief shall be responsible for assigning sufficient officers to respond to emergency calls in King City during the time that King City personnel are not on duty. 3-7 Tigard Police Department personnel responding to emergency calls for the benefit of King City shall remain Tigard employees and shall not have any King City salary, pensions, or any status or rights under- any provision of King City employment. 3.8 -Tigard agrees that at all times during the term of this Agreement, ligard shall secure, maintain, and keep current a policy or policies r ^ce with public liability, collislun, and comprehensive coverages on allvehiclesowned by Tigard and used in connection with the provision Of police services within the corporat=e limits of King City. Tigard shall also secure, maintain, and keep current a policy or policies of insurance covering professional liability for, officers engaged in police services for the City of King City. Insurance limits shall be equal to limits applicable I:0 coverage for- Tigard Police services within the corporate limits of Tigard. Insurance dQductible exclusions sn,1.1 be equal to those (Ioduclible exclusions _ applicable to the provision of poli, service within Lhe corporate limits of Tigard. Certificates of such insurance shall be provided to King City. AGREEMENT FOR POLICE SERVICES — PAGE 3 - - a 4.0 DUTIES OF KING CITY REGARDING RESPONSE TO EMERGENCY CALLS ,;. 4.1 The King City Police Chief shall provide to the Tigard Police a schedule of hours when no King City police personnel are on duty. 4.2 The King City Police Chief shall provide to the Tigard Police a list of any mutually agreed upon specialinstructions or procedures that. Tigard Police need to follow when responding to emergency calls in King City, 5.o MUTUAL OUTaES OF TIGARD AND KING, CITY REGARDING RESPONSE TO EMERGENCY CALLS 5.1 The police chiefs of Tigard and King City shall mutually agree by writton memorandum as to what constitutes an emergency call. 5.2 The police chiefs of T-igard and King City shall nmtually agree by written memorandum as to what emergency calls will require calling out a King City officer for i.mmvdinte follow--up. 6.0 DISPUTES 6.1 An advisory committee willbe established with representation from King City Police, Tigard Police, and Tigard Police Dispatch Center. This committee shall be responsible for establishing mutually acceptable operating proceoures for the Dispatch Center. 6.2 Disputes or conflicts regarding the dispatch of King City police which cannot be handled at the shift supervisor/support services manager level, shall be resolved by mutual agreement of the Chiefs of Police of King City and Tigard. 6.3 Disputes or- conflicts regarding responses to emergency calls shallbe resolved by the MIALal agreement of the chiefs of Police of King City and Tigard. 7.0 PAYMENT 7.1 Tigard will charge and King City will. pay $325.50 per month for the police dispatch services described in Section 1 above. 7.2 Tigard will charge and King City will. pay $11 .23 per- response for all Tigard police responses to emergerry calls when King My personnel are not on duty as described in. Sections 3 and 5 above. 7.3 Payment for dispatch services shall be made in advance on a monthly basis, the first paymentto be We upon the execution of this Agreement and each additionalpayment to be made on the first day of each calendar month thereafter. AGkFI?.MFNT FOR POLTCG SFRVFC1:-; -- PAGE_ 4 8.0 HOLD HARMLESS 8.1 Tigard hereby covenants and agrees to hold and save King City, its officers, employees, and agents harmless from all claims whatsoever- that may arise against King City, its officers, employees, or agents by reason of any act of King City, its officers, employees, or agents in the performance of the duties required by the terms of this Agree!nent. 8.2 King City hereby covenants and agrees to hold and save Tigard, its officers, employees, and agents harmless from all claims whatsoever that may arise against Tigard, its officers, employees, or agents by reason of any act of Tigard, its officers, employees, or agents in the performance of the duties required by the terms of this Agreement. 8.3 Tigard and King City mutually covenant and agree that neither party willinsure the actions of the other, but rather each party will assume its own responsibility in connection with any claims made by a third party against Tigard and/or- King City, 8.4 Tigard and King City agree that nothing contained in this Agreement is intended to limit the ramedy, if any, of either party against the other party, including claims under subrogation agreements with the party's insurance carrier to recover for damages to property or injury to persons caused by a party's negligence. 9.0 EFFECTIVE DATE AND RIGHT TO TERMINATE 9.1 Tigard and King City agree that this Agreement shall be effective for- a period of six months, commencing at 12:01 a.m. on the last day of January 1987 and expiring at 11:59 P.M. on the last day of June 1987. in the event that either Tigard or King City desires to renew this contract upon the expiration thereof, the city so desiring shall notify the other city at least sixty (60) days prior- to expiration of the Agreement. Within 30 days after receipt of such notir.e_, i-h- parties shall review the Compensation and any other hereof, and agree to renew the agreement as it may be modified. if agreement cannot be reached, the contract will terminate as provided above. 9.2 This Agreement may be terminated by either party without cause upon thirty (30) days prior written notice. _1. , WHOLE AGREEMENT 10.1 Other than as specifically described herein, this contract contains the entire agreement between parties and supersedes any and all other agreements, written or oral, expressed or implied, pertaining to the subject matter hereof. 10.2 This contract is subj _t to all .appli�ahl.e Public rontr'act.i.ng rnunicip.�l finance, and constitutional <trld charter d,-bt: limit-ati<.,ns f the parties and of cities generally, and is subject. to fundi being ' appropriated therefore.
