A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS KNOWN AS PACIFIC REALTY ASSOCIATES
S.W. DURHAM ROAD EXTENSION.
WHEREAS, the City executed a Street Dedication Compliance Agreement dated
October, 1984, with Pacific. Realty Associates, L.P., to facilitate
installation of a sever; hundred foot long street extension, known as Pacific
Realty Associates S.W. Durham Road Exi:ension, to specified standards and
specifications; and
WHEREAS, said Compliance Agreement stipulated that:
"Flt such time as all public improvements have been completed in accordance
with the City`s requirements, Petitioner shall notify the City of
readiness for final inspection and upon certification by the Department of
Community Development that all requirements of the City have been met, the
Council agrees to accept said improvements, for operation and maintenance
responsibility, and release the Petitioner's guarantee bond"; and
WHEREAS, Department of Community Development staff verifies That all
requirements of the City have been met;
NOW, THEREFORE, BE IT RE".OLVED by the Tigard City Council that:
The Tigard City Council hereby accepts the public improvements known as
Pacific Realty Associates S.W. Durham Road Extension;
AND, FURTHER, the City Council hereby authorizes release of the Petitioners
guarantee bond.
