Resolution No. 87-33 CITY OF TIGARD, OREGON RESOLUTION NO. a7— 33 IN THE MATTER OF THE ADOPTION OF A FINAL ORDER UPON CITY COUNCIL_ REVIEW OF AN APPEAL OF A PLANNING COMMISSION APPROVAL OF A SIGN CODE EXCEPTION CROW-SPECKER-HOSFORD ##67 (SCE 11-86) WHEREAS, this matter came before the City Council at its meeting of March 16, 1986, upon the Filing of an appeal by the Planning Commission denial of a Sign Code Exception; and WHEREAS, the City Council had before it the Planning Commission final order, the Planning staff's report, the transcript of the Planning Commission hearing and documentation submitted by the applicant as part of the application; and WHEREAS, the applicable criteria in this decision are the following: Chapter 18.114 of the Tigard Municipal Code WHEREAS, based on the record in this case, the City Council makes the following findings of fact: NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: Section 1: The subject site is located at 12100 SW Garden Park Place (WCTM 2Si 186 Tax Lot 400, 1400) within the corporate limits of Tigard, Oregon. Section 2: Th-, subject site is occupied by Park 217 Business Park. This development has one free standing sign on each of the following street frontages: 1. Highway 217 2. Pacific Highway 3. Hall Rlvd. Section 3: The applicant's request is to replace the free standing sign on Highway 217 with a sign that totals 122.5 square feet per side, has a height of 25 feet, and a 30 foot setback. There was no setback proposed before planning Commission. Section 4: Section 18.114.145 sets forth the approval criteria for exceptions to the sign code and Section 18.114.130(8) contains other criteria for modifying sign size. The City Council also makes the following conclusions of law: (1) The City council concludes that the applicant's request for a Sign Code Exception meets the approval criteria set forth it Section 18.114.145 of the Tigard Municipal Code becz� ;e the terrain and natural vegetation would make view .g of Lha sign difficult if the maximum of 22 feet required by Code was enforced. The City Council concludes that the additional size is justified because Section 16.114.130(g) of the Code grants authority to the Planning Director as part of a Site Development Review Application to approve an additional 50% of sign area under the conditions that apply to Park 217. With a 30 foot setback, a maximum sign area of 135 square feet would be possible. 3. The City Council concludes that the existing free standing sign on Highway 217 shall be removed upon installation of new sign. This sign shall have a minimum setback of 30 feet and a maximum size (per side) -f 123 square feet and height of 25 feet. A. The City Council concludes that a sign permit must be obtained from the Planning Department. and this approval is valid if exercised within one year of the decision date noted below. The City Council, therefore, orders that the above referenced determination be, and same hereby is, approved. The Council further orders that the City Recorder send a copy of the final order as a notice of final decision in this matter.
