Resolution No. 86-96 gy CITY OF TIGARD, OREGON RESOLUTION NO, 86-0 A FINAL ORDER IN THE MAI-TER OF THE APPLICATION FOR TEMPORRY USE APPROVAL REQUESTED BY TIGARD ELECTRIC, FILE NUMBER TU 4-86, APPROVING T14E APPLICATION SUBJECT TO CERTAIN CONDITIONS, ENTERING FINDINGS AND CONCLUSIONS. (TIGARD ELECTRIC TU 4-86) WHEREAS, the applicant requested a Temporary Use Permit approval to use a mobile home as an office in the CBD (Central Business District) zone temporarily up to one year; and WHEREAS, the Tigard City Council heard the above application at its regular meeting of June 9, 1986, and voted to deny the applicant's request; and WHEREAS, the Tigard City Council voted in favor of a rehearing at its regular meeting on July 14, 1986; and WHEREAS, the Tigard City Council heard the request on August 11, 1986, and voted to approve the applicant's request subject to certain conditions. NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: Section 1: The proposal satisfies the criteria necessary to approve a temporary use. Section 2: The applicant has shown that there has been a loss of leasehold occupancy rights by the applicant due to unforeseeable circumstances (or other hardship) beyond the foresight and control of th-a applicant; Section 3: The Council, therefore, ORDERS that the above referenced request be, and the same hereby is, APPROVED subject to the following conditions: 1. The approval is valid until February 28, 1987. 2. The applicant must make provisions to connect to the City sanitary sewer system through the Building Division. The applicant must obtain a sewer connection permit and abandon and fill the existing septic system by September 30, 1986. 3. The applicant shall clear all vegetation as necessary for Purposes of meeting the visual clearance requirements in Section 18.102 of the Community Development Code. 4. The applicant shall submit to both the Planning and Building Divisions a detailed, current site plan indicating all parking space, building setbacks, and exact trailer locatic- nd setbackswhich will satisfy the Planning Division's and Fire I District's requirements. RESOLUTION NO. 36-C/67 Page 1 5. The applicant shall obtain a valid Occupancy Permit for the trailer from the Building Division prior to August 31, 1986. 6. The applicant may apply for a one year extension on the office trailer. At that time, the applicant shall provide some documented proof to indicate a new site is being sought. Section 4. The Council FURTHER ORDERS that Resolution 86-68 is hereby superseded and that the Pianrling Director and the City Recorder send a copy of the Final Order as a�Notice of Final Decision to the party in this case.
