RESOLUTION NO. 86— 9,.JL-
A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS KNOWN AS PHILLIPS SANITARY SEWER
EXTENSION.
WHEREAS, the City executed a Sanitary Sewer Compliance Agreement dated May
28th, 1985, with Elton C. Phillip: to facilitate installation of a sanitary
sewer line to specified standards and specifications; and
WHEREAS, said Compliance Agreement stipulated that:
"At su-h time as all Public improvements have been completed in accordance
with tha City's requirements, Petitioner shall notify the City of
readiness for final inspection and upon certification by the Department of
Community Development that all requirements of the City have been met, the
Council agrees to accept said improvements, for operation and maintenance
responsibility, and release the Petitioner's guarantee bond"; and
NOW, THEREFORE, BE I'1` RESOLVED by the Tigard City Council that:
The Tigard City Council hereby accepts the public improvements known as
Phillips Sanitary Sewer Extension;
AND, FURTHER, the City Council hereby authorizes release of the Petitioners
guarantee bond.
