Resolution No. 86-17 C11 1-Y OF TIGARD, ORE'I RESOLUTION NO. 86— I A RESOLUTION 'TENTATIVELY ACCEPTING THE 'UBLIC STREET' IMPROVEMENTS KNOWN AS SW i 114TH COURT, LOCATED GENERALLY NORTH OF SU;MIERFIELD DRIVE AND WEST OF 109TH AVENUE, SUBJECT TO SPECIFIED CONDITIONS. _ WHEREAS, the City executed a Street Dedication Compliance Agreement, dated December 313t, 1984, with Tualatin Development Co., Inc. , to facilitate installation, of a dedicated public street and appurtances thereto, to specified standards; and wHEREAS, the Compliance Agreement stipulated that: "At such time as the Public improvements have been completed in accordance with. the City's requirements, Petitioner- shall submit a "certificate o� installation conformance" to the City to notify the City of readiness for inspection and upon notification by the Department Of Public Works that the requirements of the City have been met, the Petitioner will submit to the City a good and sufficient maintenance bond, if riot already provided with the performance bond form approved by the City, in the sum, Of x;5,600.00 to provide for correction of any defective work or maintenance becoming apparent or arising within one year- of tentative acceptance of the public improvements by the City"; and "Petitioner agrees to provide for correction of anv defective work and/or maintenance becoming apparent or arising during the guarantee period", and WHEREAS, said Certification has now been recei.vcd, subject to correction of hereinbelow listed deficiencies; and WHEREAS, Tualatin Development Co. has indicated a desire to retain the existing performance bond in full force and effect throughout the aforsaid maintenance period, in lieu Of submitting a separate bond, NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: The Tigard City Council hereby accepts the public improvements known as SW 114th Court subject to: 1.. Installation of two streetlights. 2. Continuation of the existing performance bond in full force and effect. 3. Correction of any deficiencies which exist, or may arise, and continued maintenance for a period of one year.
