RESOLUTION OF THE TIGARD CITY COUNCIL_ ACCEPTING THE PUBLIC IMPROVEMENTS
CONSTRUCTED WITHIN MILLMONT SUBDIVISION, SUBJECT TO HEREIN SPECIF.LED
CONDITIONS
WHEREAS, the City of Tigard Subdivision Ordinance requires subdivider, to
install streets, sidewalks, street lights, curbs, storm sewers, sanitary
sewers, underground utilities and other public facilities for the development
of subdivision; and
WHEREAS, the City has requireed the payment of fees and the execution of a
Compliance Agreement which stipulates that:
"Upon receipt of certification by the Department of Public Works
that all requirements have been met and a One Year Maintenance Bond,
the City Council. agrees to accept the public improvements, subject
to the requirements for correction of deficiencies and maintenance
for- a period of one year.. . .; and
WHEREAS, said Certification has now been received, subject to correction of
hereinbelow listed deficiencies; and
WHEREAS, the subdivider, has indicated a desire to retain the subdivision
performance bond in full force and effect throughout the aforesaid
maintenance period, in lieu of submitting a separate maintenance bond,
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council. that:
The City Council. accepts the public improvements constructed within Millmont
Subdivision, said subdivision being recorded in Book 60 on Paces 6&7 in
Washington County, Oregon, Plat Records, subject to:
1. Completion of installation of sidewalks.
2. Placement of the final lift of asphaltic concrete paving on all
roadways therein.
3. Continuation of the ($222,830.75) subdivision performance bond,
to assure completion of outstanding items and correction of
deficiencies which may arise during the maintenance guarantee
period. //���
