RESOLUTION NO. 86— _
RESOLUTION OF i'HE TIGARD CITY COUNCIL ACCEPTING PUBLIC IMPROVEMENTS
CONSTRUCTED WITHIN THE RIGHT-0F--WAY OF SW PFAFFI_E STREET AND SW 79TH AVENUE
ADJACENT TO CROSSROADS COMMERCIAL DEVELOPMENT'
WHEREAS, the City of Tigard required installation of streets, sidewalks,
street lights, storm sewers, underground utilities and other public facilities
for the development of Pfaffle Street and SW 78th Avenue; and
WHEREAS, the City further required the payment of fees and the execution of a
Compliance Agreement which stipulated that:
"Upon receipt of certification by the Department of Public Works
that all requirements have been met and a One Year Maintenance Bond,
the City Council agrees to accept the public improvements, subject
to the requirements for correction of deficiencies and maintenance
for a period of one year. . .."; and
WHEREAS, said Certification has now been provided to the Council; and
WHEREAS, the required performance bond remained in full rorre and effect
throughout the normally required maintenance period of one year; and
WHEREAS, no public improvement deficiencies remain to be corrected.
NOW, THEREFORE, DE IT RESOLVED by the Tigard City Council. that:
The City Council accepts the public improvements constructed within the
right—of—way of SW Pfaffl.e Street & 79th Avenue adjacent to Crossroads
Commercial Development.
