Resolution No. 86-02 CITY OF TIGARD, OREGON
RESOLUTION NO. 86-02
A RESOLUTION AUTHORIZING THE COMMUNITY DEVELOPMENT DIRECTOR TO CERTIFY THAT
LOCATIONS PROPOSED FOR DEALERS OR REBUILDERS OF MOTOR VEHICLES COMPLY WITH ALL
LAND USE ORDINANCES AND BUSINESS REGULATORY ORDINANCES OF THE CITY OF TIGARD.
WHEREAS, ORS 822.025 requires that an application for a vehicle dealer
cert'if'icate issued by the Motor Vehicle Division shall contain the following:
"(7) A certificate signed by a person authorized by the local
governing body to do so, stating that the location of the
business or proposed business complies with any land use
ordinances or business regulating ordinances of the city or
county"; and
WHEREAS, Previous State law required that the Police Chief be the individual
authorized to certify conformance with land use ordinances and business
regulations; and
WHEREAS, the State Motor Vehicle Division found the previous requirement
limiting; and
WHEREAS, the City Council finds that the Community Development Director of the
City of Tigard Planning would be more knowledgeable regarding land use
ordinances and business regulations.
NUTA, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1. The City of Tigard hereby authorizes the Director of Community
Development or his designee to certify -with his or her signature that the
location of the business or proposed business to rebuild or sell motor
vehicles complies with all land use ordinances and business regulatory
ordinances of the City.
