RESOLUTION NO. 85- �9
RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS
CONSTRUCTED WITHIN COPPER CREEK (PHASE III) SUBDIVISION AND ACCEPTING A
SIDEWALK COMPLETION BOND AND AUTHORIZING RELEASE OF THE MAINTENANCE BOND.
WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to
install streets, sidewalks, street lights, storm sewers, sanitary sewers,
underground utilities and other public facilities for the development of
subdivisions; and
WHEREAS, the City further required the payment of fees and the execution of a
Compliance Agreement which stipulates that:
"Upon receipt of certification by the Department of Public works
that all requirements have been met and a One Year Maintenance Bond,
the City Council agrees to accept the public improvements, subject
to the requirements for correction of deficiencies and maintenance
for a period of one year. . .," and
WHEREAS, said Certi'fica'tion has now been received; and
WHEREAS, an acceptable Maintenance Bond has been in effect for the aforesaid
maintenance period; and
WHEREAS, all deficiencies have now been corrected, except for installation of
certain segments of sidewalk, for which an acceptable completion bond has been
submitted.
NOW, THEREFORE, BE IT RESOLVED THAT:
The Tigard City Council hereby accepts the public_ improvements constructed
within Copper Creek (Phase Ill.) Subdivision, said subdivision being recorded
in Book S5 on Page 43 & 44 in Washington County, Oregon, Plat Records; and,
also, a_cc is the sidewalk completion bond.
AND FURTHER, the City Council herein authorizes release of the aforesaid
Maintenance Bond.
