A RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC SANII-ARY SEWER
IMPROVEMENTS KNOWN AS TfiF_ MULL SANITARY SEWER EXT04SION, GENERALLY LOCATED
WEST OF S.W. TIGARD STREET AND NORTH OF SW GRAND.
WHEREAS, the City executed a Sanitary Sewer Compliance Agreement, dated
October 5th, 1984, with George S. Mull and George E. Mull, to install a public
sanitary sewer line and appurtenances thereto, to specified standards; and
WHEREAS, the Compliance Agreement stipulates that:
"Upon receipt of certification by the Department of Public Works
that all requirements have been met and a One Year Maintenance Bond,
the City Council. agrees to accept the public improvements, subject
to the requirements for correction of deficiencies and maintenance
for a period of one year. . . ; and
WHEREAS, the original performance bond, in lieu �f a separate maintenance
bond, has remained in full force and effect throughout the normally required
maintenance period of one year, and
WHEREAS, the Public Works Department has now certified that the specific terms
and conditions of said agreement and bond have been satisfactorily completed;
and
WHEREAS, no deficiencies remain to be corrected there i.nregard,
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
They accept the public main line sanitary sewer improvements known as the Mull
Sanitary Sewer Extension;
And further herein authorizes release of the aforesaid guarantee bond.
