RESOLUTION NO.
A RESOLUTION CONCERNING VACATION OF A PORTION Cr SW TIGARD STREET, A DEDICATED
PUBLIC RIGHT-OF-AAY IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON. MULL)
WHEREAS, a vacation request has been received and filed with the City Recorder
for SW Tigard Street; and
WHERE this portion of land was previously dedicated for future street
improvements, it has been determined to riot be needed by the City for this
m
purposes; and
WHEREAS, the Tigard City Council finds it necessary and desirauie to initiate
vacation proceedings for said parcel.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
(1) That the Tigard City Council initiates the vacation request with the
understanding that those property owners who would normally sign a
petition shall be notified by mail of the proceedings and that the
City of Tigard pay all fees and charges as set out in TMC Chapter
15.08.
(2) That a public hearing is hereby called to be held by the City
Council on Monday, September 23, 1985, at 7:30 P.M. at Fowler Junior
SW Walnut Street, within the City of
High School Lecture Roam, 10865
Tigard, at which time and place the Council shall hear any
objections thereto, and any interested person may appear and be
heard for or against the proposed vacating of said lands.
(3) That the City Recorder be, and she is hereby, authorized and
directed to cause to have published in the Tigard Times, a newspaper
of general circulation in the City of Tigard hereby designated for
such purpose, a notice of said hearing in the form hereto attached
and by this reference made a part hereof, the first publication to
be August 22, 1485 and once each week thereafter- for five
publishings in all.
The Recorder be, and she is hereby, further directed to cause to
have posted within five (5) days after the date of first
publication, a copy of said notice in the form attached, at or near
each end of the area proposed to be vacated.
(q) That the particular portion of dedicated public right-of-Way
proposed to be vacated is described on the attached sheet headed
Exhibit "A" and by reference made a part hereof.

of North Tigardville Addition, a plat of record, in the Northwest Quarter of
Section 2.. Township 2 South, Range 1 West, Willamette Meridian, Washington
County, Oregon conveyed to Gregory S. Mull and George E. Mull by a deed
recorded as Document No. 83-015320 in the Deed Records of said County, said
portion 'being mora Particularly described as Foliuws:
Beginning at a point on the east line of said Mull tract that bears South
16000'00" West 10.03 feet from the northeast corner thereof, thence on said
east line South 16°00'00" West 10.00 feet to . point that is 20.00 feet
distant, when measured at right angles, From the South line of SW Tigard
Street (County Road NO. 767), thence parallel with said South line North
64-49100" West 61.69 feet to the West line of said Mull tract, thence on said
