Resolution No. 85-54 CITY OF TIGARD, OREGON RESOLUTION NO. A RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC SANITARY SEWER IMPROVEMENT KNOWN AS PHILLIPS SANITARY SEWER EXTENSION, CONSTRUCTED WITHIN THE CITY OF TIGARD, SUBJECT TO ONE YEAR VlAINTNANCE PERIOD AND SPECIFIED CONDITIONS AND AUTHORIZING A PARTIAL RELEASE OF PERFORMANCE MONIES. WHEREAS, the City executed a Sanitary Sewer Compliance Agreement dated May 28, 1985, with Elton Phillips to install a public sanitmry sewer main line and appurtenances thereto, within the City, to specified standards; and WHEREAS, The Public Works Department has now issued certification that all terms and conditions specified by said agreement have been satisfactorily completed, and WHEREAS, $1,190 is to be retained as a maintenance bond by the city to permit release of $4,760.00 of the previously submitted $5,950.00 performance bond, as allowed by said contract, ensu ring continued maintenance of the work and completion of documentation throughout a one year period; NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: The City of Tigard, Oregon, hereby accepts the public improvements, constructed within the City known as the Phillips Sanitary Sewer Extension, subject to the normal one year maintenance period, completion of easement recording and provision of an as—built mylar to the City. AND FURTHER, the City Council herein authorizes release of $4,760.00 of the previously submitted performance bond.
