Resolution No. 85-22 CITY OF TIGARD, OREGON RESOLUTION NO. 85— 2 A RESOLUTION ESTABLISHING CONTRACTOR'S PREQUALIFICATION CRITERIA FOR THE CITY'S CIVIC CENTER PROJECT; REQUIRING MANDATORY PREQUALIFICATION; AND SETTING THE TIME AND DATE TO RECEIVE THE PREQUALIFICATION APPLICATION. WHEREAS, the City may require mandatory prequalifications for all persons desiring to bid for public contracts according to ORS 279.039 (1) and the Local Contract Review Board Administrative Rule 30.025; and WHEREAS, ORS 279.037 lists reasons for which criteria need to be set that a public contracting agency may disqualify any person as a bidder for a public contract; and WHEREAS, Local Contract Review Board Administrative Rule 30.025 requires the forms to be prescribed by the Purchasing Agent; and WHEREAS, if the City requires prequalification, Local Contract Review Board Administrative Rule 30.025 states the City shall not consider the bid(s) of any prospective bidder not prequalified; and WHEREAS, ORS 279.043 mli—s any person waw Lo appeal disqualification as a bidder three business days after receipt of notice of disqualification; and WHEREAS, the Tigard City Council finds it necessary and desirable to require prequalifications in order to be assured of the reasonableness of a bid. NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: 1. The Tigard City Council acting in compliance with ORS 279.039, City's Local Contract Review Board Administrative Rule 30.025 requires mandatory prequalification for all persons desiring to bid for the Tigard Civic Center construction project. 2. To be considered as a qualified bidder on the Civic Center construction project, the person shall do each and all of the following: a. Complete the entire current form and file a notorized copy with i original signatures of Contractor's Prequalification ARPlication Equipment and Expense Questionnaire, last revised 10-83 which is attached as Exhibit A, on or before the time and place given below. b. Complete the Supplemental Prequalification Application on a copy of the form which is attached as Exhibit 3 with the Application described on 2a above. t S RESOLUTION NO. Page 1 C. Completed notorized applications must be re-Ceived by the City Recorder at City Hall offices, 12755 SW Ash, Tigard, Oregon, by 3:00 P.M., P.D.T., Monday, May 6, 1985. The contractor shall submit evidence that the contractor, can obtain a bid bond, performance bond, and labor and materials bond. The surety bonds shall be with a company approved by the City and shall have a Best's rating of not less than A+. b. The contractor shall have at superintendent or a project administrator on the sitfa who has prior experience in administering a public improvement contract for the State of Oregon, a cit , county, a special service district or one of its other polya itical subdivisions within the past five years. The administration experience shall have involved a contract in excess of $500,000. c. The contractor shall have a superintendent on the Tigard Civic Center job site who has been in the employment of the contractor as a superintendent for more than one year from the date of the invitation to bid. d. The contractor shall have a key person on the Tigard Civic Center job with prior experience in formed concrete work and office building construction. Such experience sh«11 have been with a building in excess of $500,000. e. The contractor shall not have a record of repeatedly breaching contracted obligations to public or private contracting agencies. 4. Notification of Action Taken: The applicant will be notified,'in writing, of the action on his application. fie will then be allowed _ to bid on such projects as are within the limits of size and kind of work for which he has been declared Iqualified. -Period During Which a Qualified Bidder Remains oualified: A prospective bidder who has been notified of prequalification for projects of a given size and kind will usually remain qualified until the date specified in the notification. The public contracting agency may limit prequalification approval to individual public improvement projects. Unless such bidder is otherwise notified by the public body he will be permitted to submit bids for any and all projects of said kind and size for which bids are to be received. The public body may from time to time require new or revised prequalification applications and have them approved prior to allowing a bid. Requirement of Continuing Prequalification: Prospective bidders who have once been qualified with an agency requiring prequalification and who desire to maintain an uninterrupted prequalification standing are required to submit a new application periodically as required by such agency. Uninterrupted prequalification is contingent upon favorable action on the application_ A prequalification may be revoked under the provisions of ORS 279.039. a.nanyci: Requests for revision of the prequalification standing of any prospective bidder will be considered whenever the bidder can make a showing of materially improved ability, but not more often than once in three months. Each such request must be accompanied by a new prequalification application_ With or without a request from the prequalificd bidder, the prequalification limitation on class of work or size of project may be reviewed and increased or decreased as found appropriate. The prequalified prospective bidder will be notified in writing of any such revision. Confidential information: The information furnished in the prequalification application will be treated as confidential information if so requested by the applicant. 1f so requested in item 14 of the application, contents of the application will not be disclosed to the public except upon the written order of the person or persons furnishing the same or upon an appropriate order of a court of competent jurisdiction.
