RESOLUTION NO. 85— P'Z_
RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS
CONSTRUCTED WITHIN GALLOS VINEYARD SUBDIVISION, SUBJECT TO HEREIN SPECIFIEo
CONDITIONS.
WHEREAS, the City of Tigard Subdivision Ordinance requires
subdividers to install streets, sidewalks, street lights, curbs, storm sewers,
sanitary sewers, underground utilities and other public facilities for the
development of subdivision; and
WHEREAS, the City has required the payment of fees and the execution
of the Compliance Agreement with stipulations that:
"Upon receipt of certification by the Department of Public Works
that all requirements have been met and a One Year Maintenance Bond
the City Council agrees to accept the public improvements, subject
to the requirements fur correction of deficiencies and maintenance
for a period of one year". . I; and
WHEREAS, said Certification has now been received, subject to
correction of hereinbelow listed deficiencies; and
WHEREIS, the subdivider has submitted a Maintenance Bond, replacing
the Original Performance Bond, to be in full force and effect throughout the
Maintenance Period.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
The City of Tigard, Oregon, hereby accepts the public improvements constructed
within Gallos Vineyard Subdivision, and said subdivision being recorded in
Book 58 on Pages 9 and 10 in Washington County, Oregon, Plat Records, subject
to:
1. Sidewalks need to be completed.
2. Mailboxes need to be installed.
3. A.C. Overlay on all streets after 90% of lots are completed.
4. Maintenance of all public facilities, including correction of any
deficiencies which may arise during the required maintenance
period.
