RESOLUTION NO,
RESOLUTION OF THE TIGARD CITY COUNCIL_ ACCEPTING THE PUBLIC IMPROVEMENTS
CONSTRUCI"ED WITHIN BRITTANY SQUARE 1H SUBDIVISION, SUBJEIYT TO HEREIN SPF_t;ZFIED
OONDITIONS.
WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to
install streets, sidewalks, street lights, curbs, storm sewers, sanitary
sewers, underground utilities and other public Facilities for the development
of subdivision; and
WHEREAS, the City has required the payment of fees and the execution of
the Compliance Agreement which stipulates that:
"Upon receipt of certification by the Department of Public Works that all
requirements have been met and a One Year Maintenance Bond, the City
Council agrees to accept the public improvements, subject to the
requirements for correction of deficiencies and maintenance for a period
of one year". . . ; and a One Year Performance Bond for Sidewalks.
WHEREAS, said Certification has now been received, subject to correction
of hereinbelow, listed deficiencies; and
WHEREAS, the subdivider has submitted a Maintenance Bond, replacing the
Original Performance Bond, to be in full force and effect through out: the
Maintenance Period.
NOW THEREFORE,
BE IT RESOLVED that the City Council of the City of Tigard, Oregon hereby
accepts the public improvements constructed within Brittany Square 18
Subdivision, said Subdivision being recorded in Book 56 on Page 17-18 in
Washington County, Oregon, Plat Records, subject to:
1. Sidewalks need to be installed.
2. Mailboxs need to be installed.
3. A.C. Overlay on all streets, need be install_d,
4. Maintenance of all public facilities, including correction of any
deficiencies which may arise during the required maintenance period.
And, further, the City Council of the City of Tigard, Oregon hereby accepts
the tendered Maintenance Bond and Sidewalk Performance Bond and authorizes
