RESOLUTION NO. 84 -
RESOLUTION OF THE CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED
WITHIN S.W. FANNO CREEK DRIVE (BONITA FIRS).
WHEREAS, the City of Tigard SubdivisionOrdinance
er requires subdividers
bdividers under-
install streets, sidewalksstreet lights, s
ground utilities and other public facilities for the development of subdivisions,
,
and;
WHEREAS, the City further required the payment of fees and the execution of
a Compliance Agreement which stipulates that:
"Upon receipt of certification by the Department of Public Works
that all requirements have been met and a One-Year Maintenance Bond,
the City Council agrees to accept the public improvements, subject
the requirements for correction of deficiencies and maintenance for
a period of one year..."; and
WHEREAS, said Certification has now bein received; and
WHEREAS, the required maintenance bond ' .s remained in full force and
effect through the normally required mainten..nce period of one year; and
NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby
accepts the public improvements constructed within S.W. FANNO CREEK DRIVE,
(Bonita Firs) .
AND FURTHER, the City Council herewith authorizes release of the aforesaid
bond. W�
